Estate of John Meagher late of Pictou, Yeoman, deceased, Testate

Copy of Will for the Registrar of Deeds

I John Meagher of Pictou in the County of Pictou and Province of Nova Scotia, Yeoman, Do make and publish this my last Will and testament, in manner and form following – that is to say,

I will and direct that all my just and lawful debts be paid and my funeral expenses defrayed by my Executors, out of the proceeds of my estate.

I give, devise and bequeath to my Grand Daughter, Catherine McDonald, Daughter of James and Sarah Francis McDonald Forty Dollars ($40.00)

I give, devise and bequeath to my Grand Daughter, Catherine, Daughter of John and Eliza Meagher Forty Dollars ($40.00)

I give, devise and bequeath to my Grand Daughter, Catherine, Daughter of Colin and Lucy Pearson Forty Dollars ($40.00)

I give, devise and bequeath to Elizabeth McIlwain, now residing in Boston Forty Dollars ($40.00)

I give, devise and bequeath to my son Thomas Meagher his heirs and assigns, the South half of that lot of land and buildings situate on Water Street, and Willow Street, in the Town of Pictou, and known as the Carmichael property, and also Fifty Dollars.

I give, devise and bequeath to my Daughter Jessie Meagher, her heirs and assigns, the North half of the aforesaid lot, fronting on Church Street, and Willow Street, and also Fifty Dollars ($50.00)

I give, devise and bequeath to my Grand Son John Meagher son of John T. Meagher, all my interest in that farm Situate on Merigomish Island, and known as the estate of Hector McDonald, deceased.

I give, devise and bequeath to my Daughter Catherine her heirs and assigns, all the remainder of my real estate, to hold the same in fee simple forever, together with all my personal property of every kind, whether consisting of Stock, implements of husbandry, furniture, dishes, debts, due me, money in Ban, or property of any kind which shall belong tom me at the time of my decease.

I give, devise and bequeath to my Grand Daughter Catherine, Daughter of David and Jane Meagher, now residing in Boston, Forty Dollars. ($40.00)

Finally I hereby nominate and appoint David McKay of Millbank Farm, Esquire, my son in law James McDonald, and my Daughter Catherine, Executors of this my last Will and testament, giving them full power to transact all business connected with the execution of this my last Will and Testament, and I hereby revoke all Wills and Testaments, heretofore by me made and executed.

In witness whereof I have hereunto Subscribed my name and affixed my Seal, at Pictou this twenty Sixth day of June, in the year of our Lord One Thousand Eight hundred and ninety.

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of John Meagher (Senior), late of Pictou in the County of Pictou, Yeoman, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
