Estate of Jean Harper, late of Pictou, Spinster, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

This is the last Will and Testament of me Jean Harper of the town and County of Pictou, Singlewoman.


I give devise and bequeath unto Montgomery Harper of Pictou, Gentleman, and Elizabeth his wife for life and for the life of the Survivor my lot of land with the house and buildings thereon Situate on North Side of Church Street and bounded on West by land of Murray and East by land of Marshall and after the death of the Survivor I and devise the same to my cousins James Harper of Frizington England, overseer of Coal Mine, and Robert Harper of Polickshalds, Glasgow, Scotland, Trader, to hold the same to them as tenants in common their heirs and assigns forever.

I order and direct that the said Montgomery Harper and Elizabeth his wife shall while they and the survivor of them hold and enjoy said land and premises insure and keep insured at his or her expense the house now erected on said lot of land against loss or damage by fire in the names or name of my executors and trustees hereinafter named, and the survivor of them, for such sum or sums of money as my Executors or Trustees or the Survivor of them may direct and also that the said Montgomery Harper and Elizabeth his wife and the Survivor of them shall and will during their lives and the life of the Survivor pay and discharge all taxes, rates, and assessments of every kind and description or lived on said land or premises and in the event of said dwelling house now erected or hereafter to be erected on said lot being destroyed by fire the I order and direct my said executors and trustees or the Survivor of them out of the moneys received from said insurance erect a new dwelling therein or pay the interest money arising from said money to the said Montgomery Harper and Elizabeth his wife for life and for the life of the Survivor and afterwards pay over the principal and interest if any, to the said James Harper and Robert Harper, and their heirs absolutely.

I give devise and bequeath unto Allan A. Ferguson, Farmer, and George E. Elliot Barrister at Law, of the town and County of Pictou, and the Survivor of them, whom I hereby name and appoint Executors and Trustees under this my last Will the sum of Six thousand Dollars Canada money upon trust to invest the same and the interest or dividends arising therefrom to pay the said Montgomery for life and should the said Elizabeth survive her said husband, I hereby Authorize and direct the Survivor to pay to pay the interest or dividend upon the sum of Three thousand Dollars to her for life if she remains a widow bout should she remarry then the said payment to at once cease and end.

After the death of the said Montgomery Harper I hereby Authorize and direct my said executors and Trustees and the survivor to pay over to the said James Harper and Robert Harper and their heirs the sum of Three thousand Dollars, and after the death of the said Elizabeth or on her remarrying to pay over to the said James Harper and Robert Harper and their heirs the remaining sum of Three thousand Dollars, and should the said Elizabeth die before the said Montgomery Harper the I order and direct that my said executors and Trustees and the survivor of them shall pay over to the said James Harper and Robert Harper and their heirs the said sum of Six thousand Dollars and accrued interest or dividends.

I give devise and bequeath to the Trustees for the time being of the Presbyterian Church of  St. Andrew's at Pictou, and their Successors Fifty Dollars to be used and expended by them in keeping in order the old Presbyterian cemetery on west side Wellington Street, in Pictou, also Fifty Dollars for the use of Sunday School of said St. Andrew's Church at Pictou, also one hundred dollars for the Foreign Mission Fund of said church.

I give devise and bequeath to the Reverend Hugh Robertson for the benefit of the Anietyum Mission in the New Hebrides One hundred Dollars the same to be paid out of my personal Estate.

I give devise and bequeath to Clara Sterling Widow of the late David Sterling of Charlotte Town, Prince Edward Island the picture of Melrose Abbey.

I give unto Henry B. Sterling infant son of the said late David Sterling the gold watch and chain presented by his father the said David Sterling.

I give unto Robert Harper my cousin hereinbefore named the gold watch of my late father Robert Harper.

I give devise and bequeath to the Pictou Young Mens Christian Association for the Town Mission in connection therewith One hundred Dollars to be paid out o my personal estate.

I give devise and bequeath to the said Elizabeth wife of said Montgomery Harper a Silver teapot and Kettle.

I give unto the said Montgomery Harper for life all my Silver plate consisting of spoons and forks and other articles, also plated goods, and after the death of said Montgomery Harper I give devise and bequeath the same to the said James Harper and Robert Harper absolutely.

I give devise and bequeath all m y household furniture contained in dwelling wherein I am now living (Silver plate and plated goods and articles hereinafter mentioned affected) to Margaret Thain of the Town and County of Pictou, Spinster, for life and after death to Ellen McKenzie, Margaret J, McKenzie, and Eliza McKenzie all of Carriboo in said County Spinsters To Hold the same to them absolutely.

I give devise and bequeath to Annie McLeod of the town and County of Pictou, Spinster, two pictures hanging in room in Southern part of house in which I am living and pointed out by me to my executor and Trustee the said George H. Elliot as intended for the said Annie McLeod, also one hardwood table in the kitchin in house aforesaid to hold to her absolutely.

All the rest and residue of my estate and personal after payment of m y debts, funeral and testamentary expenses, and the expenses attendant on closing my Estate, I give devise and bequeath the same to the said James Harper and Robert Harper absolutely.

I nominate appoint and confirm the said Allan A. Ferguson and George E. Elliot and the Survivor of them executors and Trustees under this my last Will and Testament.

I hereby revoke all former Wills and Testaments by me at any time heretofore nade and declare this to be my last Will and testament.

In witness whereof I the said Jean Harper the Testatrix have to this my last Will and testament contained or written in or upon seven sheets of paper Set my hand this third day of December in the year of our Lord one thousand eight hundred and ninety five.

I do hereby certify that the foregoing instrument consisting of five & a half pages, is an exact and literal copy of the last Will and Testament of Jean Harper late of Pictou, in the County of Pictou, Spinster, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
