Estate of George J. Hamilton, late of Pictou, Merchant, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

This is the last Will and Testament of me George Johnston Hamilton of Pictou in the County of Pictou, And Province of Nova Scotia, Merchant.
 
I hereby order and direct that all my just debts including Mortgage debts on any part of my Real estate, funeral and testamentary expenses be paid  and discharged by my executors hereinafter named or appointed, or the survivor of them out of my personal estate as soon as conveniently may be after my decease.

I give devise and bequeath to my son Clarence Hamilton his heirs and assigns for ever, all that lot of land and premises with the buildings thereon situate on Dawson Street and Kempt Streets in the town of Pictou, being the same lot of land and premises as was purchased by me from Jessie Benton.

I also give devise and bequeath to my said son Clarence Hamilton his heirs and assigns for ever that lot of land and premises situate on the eastern side of the lane or street leading to Yorston's Wharf in the town of Pictou, being that part of the lot whereon the building containing shop and dwelling formerly occupied by me is situate, with use of right of way thereto from Kempt Street and to embrace and contain that part of the lot which I bought from the late Abram Patterson not including the land covered by bakery and warehouse and land now used in connection therewith, and hereinafter devised to the said Clarence Hamilton and Howard H. Hamilton.

I also give devise and bequeath to my said son Clarence Hamilton his heirs and assigns for ever all the remaining part and residue of that lot of land and premises purchased by me from James Murdoch Esquire, since deceased, Situate in rear of the town of Pictou aforesaid containing Seven and a quarter acres more or less and adjoining a lot of land now owned by the said Clarence Hamilton.

I also give devise and bequeath unto my said son Clarence Hamilton his heirs and assigns for ever all that lot of land and premises purchased by me from Nicholas Beck situate in rear of the Town of Pictou aforesaid and containing ten acres more or lefs.

I also give devise and bequeath unto my said son Howard H. Hamilton his heirs and assigns forever that lot of land with the double dwelling house thereon, together with the outhouses and appurtenances, Subject to the occupation in part of my wife and sister for life, as hereinafter mentioned, said lot being situate on the north side of the beeches Road so called, and being the whole of that lot at present occupied by me and the said Howard H. Hamilton.

I also give devise and bequeath unto my said son Howard H. Hamilton his heirs and assigns for ever that lot of land, and land covered with water situate in the town of Pictou aforesaid, being the same lot as was purchased by me from one Dougald Renton and adjoining a lot now owned by the said Howard H. Hamilton.

I also give devise and bequeath unto the said  Howard H. Hamilton his heirs and assigns for ever, all that lot of land with the buildings thereon situate at the corner of Colraine and Water Streets in the said town of Pictou, being the same lot of land and premises as purchased by me from on William Campbell.

I give devise and bequeath unto my Grandson George, the son of the said Clarence Hamilton Five hundred Dollars Canada money - also the musical organ now in my house and my watch.

I give devise and bequeath unto my wife Margaret Hamilton for life (except as hereinafter excepted) that part of the said double dwelling house, as at present occupied by me and outbuildings thereon, together with all the furniture, Silver ware, plate, other furnishings and personal property contained in said dwelling house for the term of her natural life, excepting however that bedroom solely occupied by me in the said dwelling house which I hereby give and bequeath unto my sister Jessie Boyd with free ingress and egress thereto and there from at all times through said house and land whereon said house is built for her own use and occupation for life should be required.

I give devise and bequeath unto my wife Margaret Hamilton for life the annuity and sum yearly of three hundred dollars of lawful money of Canada, to be paid by said executors, or the survivor of them hereinafter named, in quarterly installments, which with what I have already given her I mean to be and that she accept the same in full of all her right of dower in and to my real estate so devised as aforesaid, and I give the said annuity to her upon condition that she my said wife shall give to my executors hereinafter named or the survivor of them when demanded a release of all demands and claims of dower and otherwise of and against my estate same what I have hereinbefore given her.

I give devise and bequeath unto my said sister Jessie Boyd the annuity or sum yearly of Fifty Dollars the same to be paid for the term of her natural life in quarterly installments by my executors hereinafter mentioned.

I give devise and bequeath unto my said sons Clarence Hamilton and Howard H. Hamilton, their heirs and assigns forever, all the lots of land whereon the bakery and ware house in connection therewith now stand, the lots whereon the said buildings stand having been bought by me from Abram Patterson and Margaret Taylor by different conveyances and being situate on the west side of Kempt Street in the town of Pictou, and I hereby make the said lots and buildings thereon, together with all machinery contained in said buildings chargeable with the respective life annuities to my said wife and sister hereinbefore mentioned.

I also give devise and bequeath unto the said Clarence Hamilton and Howard H. Hamilton absolutely all and every description of Machinery and all and every appliance of every kind and Sort in the bakery establishment carried on by the said Clarence Hamilton and Howard H. Hamilton under the firm names, the same being subject to the bequests hereinbefore contained.

I give devise and bequeath unto the said Clarence Hamilton and Howard H. Hamilton absolutely all the rest and residue of my real and personal property of every kind and nature whatsoever and wheresoever situate, and all rights and interests in real and personal property to which I shall be entitled as law or in equity at the time of my death.

 

I hereby revoke all former wills and testaments by me at any time heretofore made.

It is my wish and desire that after my death by body shall be buried in the lot in the Church of England cemetery near the town of Pictou.

I nominate and appoint my said sons Clarence Hamilton and Howard H. Hamilton and the survivor of them, Executors and Executor of this my  last Will and Testament, and should any difference or dispute arise between my said executors as to the manner in which they shall wind up my estate, or carry out the contents of this my said last will, I hereby appoint George H. Elliott of Pictou, aforesaid, Barrister to settle said difference or dispute he having a full knowledge of the way in which I wish my estate closed and the contents of my said will carried out.

In witness whereof I have hereunder my hand and affixed my Seal this twenty third day of August in the year of our Lord one thousand eight hundred and eighty six.

I do hereby certify that the foregoing instrument consisting of five pages, is an exact and literal copy of the last Will and Testament of George Johnston Hamilton late of Pictou, in the County of Pictou, Merchant, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
