Estate of James Grant, late of River John, Millwright, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

I, James Grant Millwright of River John in the County of Pictou, Bring of sound and disposing mind and memory do make this my last Will and Testament.


1st. First.  I order that all my lawful debts be paid and that a Suitable monument be erected at my grave by my Executor hereinafter named out of my personal property.

2nd. Second. I give devise and bequeath unto my nephew Peter Grant Son of my late Brother John, all my Real Estate of whatever nature (viz Houses and Lands) that I may be possessed of at the time of my decease (not including mortgages held as securities) together with all the Farm stock and Farming Implements, Household Furniture and furnishings and Crops of any kind that may be on the Farm we now occupy at the time of my decease, to be his and his heirs forever.

3rd. Third. I order that should my sister Elizabeth Grant survive my decease, that she shall be maintained and provided for in a respectable manner by my nephew Peter Grant mentioned above.

4th. Fourth. I order that all the balance of my property of whatever nature viz- mortgages, notes of hand, Bank stock, Deposit receipts, Book accounts, monies, etc. shall be collected and distributed by my  Executor hereinafter named as follows -

5th. Fifth. I give and devise unto my Sister Margaret wife of Peter Anderson or her Heirs the sum of ($1,000) one Thousand dollars.

6th. Sixth. I give and devise unto my Sister Euphemia widow of late Alexr. Grant the sum of ($1,000) one Thousand dollars or her Heirs.

7th. Seventh. I give and devise unto my Sister Catherine, wife of David Hinds or her Heirs the sum of ($1,000) one thousand dollars.

8th. Eighth. I give and devise unto my niece Janet Grant, Daughter of my late Brother John, the sum of ($1,000) one thousand dollars.

9th. Ninth. I give and devise unto my niece Euphemia wife of George Sutherland or her heirs the sum of ($200) two hundred dollars.

10th. Tenth. I give and devise unto my niece Henrietta wife of Daniel McDonald or her Heirs the sum of ($100) one hundred dollars.

11th. Eleventh. I give and devise unto my niece Anna Bell wife of William B. Moore or her Heirs the sum of one hundred dollars.

12th. Twelfth. I give and devise unto my niece Elizabeth Grant, should she survive my decease the sum of ($300) three hundred dollars.

13th. Thirteenth. I give and devise unto my nephew John R. Grant the sum of ($100) one hundred dollars.

14th. Fourteenth. I give and devise unto my nephew James Grant, the sum of ($500) Five hundred dollars - to be paid in installments of Fifty dollars per year should my Executor deem it expedient to do so.

15th. Fifteenth. Should my property exclusive of what is bequeathed to nephew Peter Grant, be insufficient to pay the foregoing orders and bequests then it is to be taken of the bequests by an equal percentage, or should my property exceed the foregoing then the surplus is to be added by an equal percentage to the foregoing bequests.

16th. Sixteenth. I hereby nominate and appoint Robert McNeil Esquire of Little harbor to be my Sole Executor of this my  last Will and Testament hereby revoking all or any former Wills or testaments made by me.

I do hereby certify that the foregoing instrument consisting of two page and a half pages, is an exact and literal copy of the last Will and Testament of James grant late of River John in the County of Pictou, Millwright, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou this 7th day of February A.D. 1887.
