Estate of William Graham, late of Stellarton, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

In the name of God, Amen!
 
I William Graham of Stellarton in the County of Pictou Province of Nova Scotia and Dominion of Canada, Gentleman, being of sound and disposing mind and memory Do make and publish this my last Will and Testament as follows.

First. I will and direct that all my just debts (if any) Funeral and Testamentary expenses be paid as soon as may be after my decease by my executors hereinafter named out of my residuary Estate.

Second - I give and bequeath unto my daughter-in-law Mary Anne Graham the debtor sum of Two Thousand Dollars which she owes on her Mortgage to me dated the twenty-seventh day of March A.D. 1875 and I desire my executors hereinafter named to release and give up to her the said Mortgage and any other security I may hold for the said debt and I direct that this bequest shall notwithstanding the death of the said Mary Anne Graham in my life time operate and ensue for the benefit of her heirs executors and administrators and as a complete and perfect release of the said Mortgage debt.

Third - I give and bequeath to William Richardson of Dipton in the County of Durham, England One Hundred and Fifty Pounds Stirling to be paid in two months after my decease.

Fourth - I give and bequeath to my sister-in-law Anne Richardson, widow of Thomas Richardson at present Lead Gate in the County of Durham, England One Hundred and Fifty Pounds Stirling to be paid in two months after my decease.

Fifth - I give and bequeath to Mary Anne Lamb, wife of John Lamb now of Newcastle upon Tyne England the sum of One Hundred and Fifty Pounds Stirling to be paid two months after my decease.

Sixth - I give and bequeath to my niece Elizabeth Taylor wife of James Taylor of Gateshead in the County of Durham England the sum of One Hundred and Fifty Pounds Stirling to be paid two months after my decease.

Seventh - I give and bequeath to my niece Hannah Stevenson wife of George Stevenson living near Newcastle-on-Tyne England the sum of One Hundred and Fifty Pounds Stirling to be paid two months after my decease.

And I will and direct that the amounts payable to the said Anne Richardson, Nary Anne Lamb, Elizabeth Taylor, and Hannah Stevenson be paid to them for their separate use, respectively and in case any of the aforesaid legatees should be dead at the time above mentioned for payment that then the aforesaid sums be paid to the legal representatives of such deceased person or persons respectively.

Eighth - I give and bequeath to William Graham Lawther son of Thomas Lawther of Westville in the County of Pictou aforesaid Twenty shares of the stock I now own in the Albion Mines Savings Bank the interest of which to be paid to his Thomas Lawther for his use till he comes of age, and should he die unmarried or under age, then the aforesaid legacy to be held by the same Thomas Lawther for his other Children till they respectively be married or come of age.

Ninth - I give and bequeath to Alice Isabel Lawther daughter of Said Thomas Lawther Twenty shares of my stock in the said Albion Mines Savings Bank the interest of which to be paid to her said Father for his use until she comes of age or is married and should she die under age or unmarried then the aforesaid legacy to be held by the said Thomas Lawther for his other children till they respectively come of age or be married.

Tenth - I give and bequeath to Mary Anne Bleukinsoff God-daughter and daughter of Thomas Bleukinsoff Ten shares in the said Albion Mines Savings Bank to be paid to her two months after my decease or if she should then be dead unmarried then to her said father for the use of his other children share and share alike.

Eleventh - To John Knox Bleukinsoff, I give and bequeath Ten shares in the said Albion Mines Savings Bank the interest of which to be paid to his father till he comes of age for his use and should he die unmarried or under age, then to his said father for his other Children share and share alike until they respectively come of age or be married.

Twelfth - I give and bequeath to my God-daughter Laura Bleukinsoff daughter of said Thomas Bleukinsoff, Ten shares in the said Albion Mines Savings Bank the interest to be paid to her said father for her use until she comes of age or is married and should she die unmarried or under age then to her said father for his other Children share and share alike until they respectively come of age or be married.

Thirteenth - To Minnie Leona Graham adopted daughter of my daughter-in-law Mary Anne Graham I give and devise the lot of land at Stellarton aforesaid, on which I now reside with the buildings thereon and which lot is described as follows, to wit: Bounded on the South East by the principal street in Stellarton aforesaid, on the North East by  lot in charge of Duncan McKay, on the North West by a lot in possession of John McIntosh, and on the South West by a lot in possession of Archibald C. Grant To Have and To Hold the same to her her heirs and assigns forever to same to be for the use and under the management and control of the said Mary Anne Graham until she the said Minnie Leona Graham arrives at the age of twenty one years or is married under that age.

Fourteenth - I give and bequeath all the Household Furniture belonging to me to my said  daughter-in-law Mary Anne Graham and Isabella Lawther wife of said Thomas Lawther to be equally divided between them, or otherwise disposed of as they may think right.

Fifteenth - All the rest and remainder of my property and effects, whatsoever and wherever situated, I  give devise and bequeath to my said daughter in law Mary Anne Graham and I hereby direct that in addition to the payment of my debts funeral and other expenses, she causes to be erected over my grave a decent and Suitable Monument, or Tombstone, feeling certain that she will do what is becoming and proper in the premises.

Sixteenth, and lastly, I nominate and appoint the said Mary Ann Graham executrix and the said Thomas Bleukinsoff and Thomas Lawther, Executors of this my  last Will and Testament, hereby revoking and disallowing all other wills by me at any time heretofore made, and publish and declare this only to be my  last Will and Testament.

In witness whereof I have hereunto Set my hand and Seal this second day of March in the year of our Lord 1878.

I do hereby certify that the foregoing instrument consisting of five pages, is an exact and literal copy of the last Will and Testament of William Graham late of Stellarton, in the County of Pictou, Gentleman, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou, this 30th day of January A.D. 1880.
