Estate of Howard Fullerton, late of New Glasgow, Merchant, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

Know all men by these presents that I Howard Fullerton of New Glasgow in the County of Pictou, Merchant, being of sound and disposing mind and memory do make and publish this my last Will and Testament as follows:

All my real and personal estate of which I shall die seized or possessed or to which I shall be entitled at the time of my decease I devise bequeath and dispose of in the manner following -

First,  my will is that all my just debts and funeral expenses shall  by my executors hereinafter named  be paid out of my estate as soon after my decease as shall by him be found convenient.

Second, My will further is that as soon after my decease as shall be convenient my executors hereinafter named  shall sell and dispose of my estate both real and personal and convert the same into money collecting al debts due me at the time of my decease using his own discretion as to the time and manner of Such Sales and collections, and I hereby invest my said executor with full power and Authority and without permission or license from the Court of Probate or any other Court to sell and convey to any purchaser or purchasers for such sum or sums as to him may seem best any real estate of which I may die seized or possessed giving good and valid deeds thereof in his own name as such Executor to such purchaser or purchasers.

Third, I give devise and bequeath to the Home Missionary Board of the Baptist Convention of Nova Scotia, New Brunswick, and P.E. Island (incorporated 1885) the sum of three thousand five hundred dollars, hereby appointing the said "Board" my trustees to invest the said sum of three thousand five hundred dollars in good and valid Securities and to pay the annual income thereof to the New Glasgow associated Baptist Church a body corporate hereinbefore called the :New Glasgow Church:
 
to be used for the general purpose of the said New Glasgow Church for and during Such time as the said New Glasgow Church may require the same for its support and in the event of the said New Glasgow Church becoming discontinued or no longer in need of the same for its support the said principal money of three thousand five hundred dollars in such case to be divided equally between the said "Home Mission Board" - my trustees and the Foreign Missionary Board of the said Baptist Convention to be disposed of as to the said Home and Foreign Missionary Boards may seem best.

In the event of any question arising or any dispute as to the time when the said "New Glasgow Church" shall no longer require the said annual income for its supp-rt the same shall be settled by three arbitrators to be chosen as follows, that is to say one of the said arbitrators to be selected by the said New Glasgow Church, one by the Foreign Missionary Board, my trustees and the third or umpire to be mutually chosen by said Trustees and the said New Glasgow Church, and the decision of any two of such arbitrators shall be final and binding which decision my said trustees are hereby Authorized to carry out.

Fourth, I give devise and bequeath to James Roy of New Glasgow al my interest in one share of the Capital stock of the Nova Scotia Steel Company (limited) which share already stands in the name of the said James Roy.

Fifth, I give devise and bequeath to Harriet Roy my mother her heirs, executors, administrators and assigns forever the sum of one thousand dollars.

Sixth, I give devise and bequeath to Mary A. Olding the wife of Michael C. Olding of Woodburn Pictou County her heirs, executors, administrators and assigns forever the sum of five hundred dollars.

Seventh, I give devise and bequeath to Jane G. Olding of said Woodburn her heirs, executors, administrators and assigns forever the sum of three hundred dollars.

Eighth, All the rest and residue of my said estate real and personal or otherwise of which I shall die seized or possessed I give devise and bequeath to equally divided between and among (1) Reverend Pete S. McGregor (2) Joseph Kitchen both of New Glasgow and (3) the New Glasgow associated Baptist Church a body corporate above mentioned to be distributed in the discretion of the pastor and deacons thereof for the time being for charitable purposes among the poor of the town of New Glasgow the said Peter S. McGregor and Joseph Kitchen each to take one third of said residue to them and to each of their heirs, executors, administrators and assigns forever and the said New Glasgow Church to dispose of the remaining one third of said residue as above directed.

And lastly I do nominate and appoint Michael C. Olding of Woodburn in the County of Pictou to be executor of this

In testimony whereof I the said Howard Fullerton have to this my  last Will and Testament Subscribed my name and affixed my Seal this twenty seventh day of April in the year of our Lord one thousand eight hundred and eighty five.

I do hereby certify that the foregoing instrument consisting of three pages, is an exact and literal copy of the last Will and Testament of Howard Fullerton late of New Glasgow, in the County of Pictou, Merchant, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou, this fourth day of July A.D. 1885.
