Estate of William Fraser, late of Westville, Carpenter, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

I William Fraser of Westville in the County of Pictou,  and Province of Nova Scotia, Carpenter, being of good and perfect mind and memory, and knowing the uncertainty of time, do make and ordain this my last Will and Testament.

First and principally I commit my soul to God who gave it, and my body to the earth to be buried with a decent Christian burial believing the same shall rise again at the general judgement, and the effects with which God has been pleased to bless me,  I give, devise and bequeath in manner following -

I give, devise and bequeath to my beloved wife Isabella Fraser, that certain lot of land situate at Westville aforesaid on which I now reside, bounded on the East by land of Murdoch McKay, on the South East by land of John McIntosh, on the Southwest by land of Alexander Graham and on the North West by the Gairloch road, containing three thousand Square feet more or less, with the buildings and appurtenances thereto belonging- together with the furniture, Stoves, cooking utensils, and furnishings, all moneys, books, papers, accounts, notes and securities of whatever kind and my wearing apparel. To have and to hold the said described lot of land and premises with the appurtenances to her the said Isabella Fraser during the term of her natural life, and at her decease the said above described premises with the appurtenances to revert to my daughter Margaret McKay wife of Murdoch McKay of Westville, To Have and to Hold to her the said Margaret McKay and her heirs and assigns.

I also give, devise and bequeath to my said wife that other certain lot of land with the buildings thereon, situate at said Westville and bounded on the North east by land of Robert Sutherland (Plasterer) on the South east by part of the Chelsea School lot (so called) on the South west by a vacant lot now or formerly owned by one Robert White and on the North west by a Street, containing in all Ten Thousand nine hundred square feet, more or less, with all and singular the appurtenances, together with the rents issues and profits thereof, to her, my said wife during the term of her natural life, subject however to the proviso hereinafter mentioned, and none other.

Provided however that should my Executors hereinafter named, think it best for the interest of my said wife - daughter, and my Sons to sell the herein last mentioned lot and premises, I hereby give the power so to do, the whole proceeds of said Sale (after deducting actual and necessary expenses of said Sale to be divided equally between my said wife Isabella Fraser, my two sons, John Fraser and Daniel Fraser and my daughter Margaret McKay wife of Murdoch McKay.

I give and bequeath to my son John Fraser all my Carpenter tools of whatever kind now in my possession for his Sole use and benefit.

I also give and bequeath to my said wife all debts due me or monies due and owing me, and who is hereby bund to pay all just debts and legal claims against me.
I hereby appoint my son John Fraser of Stellarton, Postmaster, and Murdoch McKay of Westville, Shoemaker, Executors of this my  last Will and testament. at the same time revoking all wills  or testamentary dispositions by me made heretofore.

In witness whereof I the said William Fraser, the testator have to this my last Will and Testament, signed  and Sealed and  published and declared this instrument as my will at Westville in the County of Pictou, aforesaid this sixth day of June, in the year of our Lord one thousand Eight hundred and eighty five.

At Westville aforesaid on the sixth day of June Anno Domini 1885, the above named William Fraser Signed & Sealed  this instrument, and  published and declared the same as and for his last Will, and we in his presence and at his request and in the presence of each other have hereunto subscribed our names as witnesses.

I do hereby certify that the foregoing instrument consisting of two and a quarter pages, is an exact and literal copy of the last Will and Testament of William Fraser late of Westville, in the County of Pictou, Carpenter, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou, this 29th day of September A.D. 1885.
