Estate of Thomas Fraser "Deacon", late of New Glasgow, deceased, Testate
Certified Copy of Will and Codicil for the Registrar of Deeds
I, Thomas Fraser "Deacon: of New Glasgow in the County of Pictou,
Being in Possession of a sound and disposing mind and memory and taking into consideration the uncertainty of life and the certainty of death,
Do make, Publish and declare this my last Will and Testament -
And to such Worldly property wherewith it hath pleased Almighty God to bless me with, I dispose of as follows,
1st. To Mrs Medley Fraser, Widow of Donald A. Fraser, I give and bequeath and devise the House and lot on which she now resides, Situate on the road leading from New Glasgow to Abercrombie Point, Size of lot (11) eleven Rods by (23) Twenty three Rods.
2nd. To John Marshall Fraser my son,
I give and bequeath and devise the lot of land Situate on the East side of Abercrombie Point road, and bounded on the North by land belonging to the Estate of the late Daniel Cameron, and on the South by the present lane leading from the Barn to said Road, containing (2) Two Acres.
3rd. To my Daughter Sophia Fraser, "Widow"
I give and bequeath the sum of One Dollar.
4th. To my Daughter Margaret, Wife of Edward McGregor,
I give and bequeath the sum of One Dollar.
5th. To James William Fraser my son, the lot of land on which his house now stands, Bounded on the East by the Halifax Company's Line of Railway ad running West to Mrs. Medley Fraser's lot, Containing two Acres more or less.
6th. To said James Wm. Fraser my son , all the land I won on the west side of Abercrombie Point Road, including a lot of Wood land, purchased from my brother William.
7th. To said James Wm. Fraser, my Son, all the lot of land commencing at the second post on the North east side of his garden lot near Mrs. medley Fraser's lot, and running from thence, northwardly, the line to pass on rod East, from the East corner of the barn, and continuing in the same direction till it strikes the line of land belonging to the Estate of the late Daniel Cameron, thence Westwardly along said line until it comes to the boundary of John Marshall Fraser's lot of land, thence southerly to the lane running from the barn to Abercrombie Point Road, thence Southwardly along said road until it comes to within one Rod of the North side line of Mrs. Medley Fraser's lot, thence Eastwardly Paralel with said line until it comes to the Starting line.
8th. To James Wm. Fraser my son, also all the Horses, farming utensils, and implements for farming.
9th. To my wife Catherine all the residue of my Real Estate and appurtenances together with the rents, issues and profits thereof, including the rent of the right of way of the Halifax Company's railway, through said lands, for the term of her natural life, and at her death, the Real Estate to be equally divided between (word scratched out and initialed) mu daughters Agnes and Sarah, and the rent of the Halifax Company's Railway in equal parts between my son James William and my daughters Agnes and Sarah.
10th. To James William my son, and my daughters Agnes and Sarah, all the live stock of sheep and horned cattle the same to be equally divided between them.
I do hereby nominate and appoint James W. Fraser my son to be my Sole Executor of this my Will.
In witness whereof, I have Signed, Sealed, Published and declared this Instrument as my Will at New Glasgow in the County of Pictou, Nova Scotia, on this the fifteenth day of March A.D. 1880.

The said Thomas Fraser "Deacon", at said New Glasgow on this the fifteenth day of March A.D. 1880 Signed and Sealed this written instrument and published and declared the same as, and for his last Will. And we at his request and in his presence, and in the presence of each other, have hereunto subscribed our names as witnesses.

CODICIL
I hereby expressly confirm my former will, dated the fifteenth day of March A.D. 1880, excepting so far as the disposition of my property is changed by this Codicil.
In the (7th.) Article of said Will it is my intention that "the line running from the second post on the North east side of James William Fraser's garden lot, and running from thence Northwardly" shall be changed and the line shall be made as follows, "beginning ay an iron bolt (4) four rods (1) 1 foot and (9) nine inches, west from a stone o the line between my land and the land of the estate of Daniel Cameron, and running from said iron bolt Southwardly to an iron bolt (12) twelve rods and (13) thirteen feet, thence to the board fence east of the barn and running Southwardly along said board fence and gate to the fence which runs eastwardly to the garden fence until it comes to within one rod of the second post mentioned in the said Article, all other directions to remain the same as in said Article."
And further out of the Estate hereby bequeathed and devised in the (9th.) ninth article of said Will, it is my intention that there shall first be measured off as follows,
Beginning at the gate post of the board fence at the east side of the barn, and running up the hill northwardly (2) two Rods, thence Eastwardly and paralel with the line between my land and the lands of the estate of Daniel Cameron, to within one Rod of the Railway fence, thence Southerly keeping distant (1) rod from said Railway fence to the centre of the brook, thence up the Stream of said brook all the way to the little Bridge, thence to the place of beginning
which said lot of land as then measured I hereby give devise and bequeath to David Fraser my Daughter Sarahs son.
In witness whereof, I have Signed, Sealed, Published and declared this Codicil to my said last Will and Testament this the twentyeth day of December A.D. 1880.

I do hereby certify that the foregoing instrument consisting of five pages, is an exact and literal copy of the last Will and Testament and Codicil to said Will of Thomas Fraser, late of New Glasgow in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
Given under my hand at Pictou this 1st. day of March A.D. 1881.
