Estate of John Fraser, late of West River, Farmer, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

In the name of God, Amen. The twenty fourth of July in the Year of Our Lord one thousand eight hundred and Sixty four.

I, John Fraser of West River in the County of Pictou, being of perfect mind and memory therefore calling into mind the mortality of the body, knowing that it is appointed for all men once to die, Do make and ordain this my  last Will and Testament. 

Principally and first of all, I recommend my soul into Almighty God who gave it, and my body I commit to the Earth to be buried in decent Christian  burial at the discretion of my Executors.

And as touching such worldly estate, wherewith it hath pleased God to bless me with in this life- I give, demise, and dispose of the same in the following manner,

First, I give and bequeath to my eldest daughter Elizabeth Fraser, Five pounds of good and lawful money of Nova Scotia.

Secondly, I give and bequeath to my second daughter Mary Fraser Five pounds of good and lawful money of Nova Scotia.

Thirdly, I give and bequeath to Jessie Matilda Fraser, my third daughter also, Five pounds of good and lawful money of Nova Scotia.

Fourthly, I give and bequeath to my eldest son Daniel Fraser, Two shillings and Six pence Nova Scotia currency.

Fifthly, I give and bequeath to my youngest son William Fraser, all and singular my Lands, messuages, and tenements, with the appurtenances and Buildings together with all and singular Farming Implements, the team and Stock consisting of Horses, Cattle, and Sheep, the f**ers, wagon, and riding saddle, subject to the following conditions,

that he the said William Fraser, shall give ad deliver in good order, to my Margaret Fraser, my beloved wife and his mother, Yearly and every year during her natural life the following goods and chattels, namely.

Three hundred Pounds weight of good marketable flour, Three hundred pounds weight of god marketable Oatmeal, Two Cows, and four Sheep, the same to be wintered and pastured yearly and every year, during the natural life of the said Margaret Fraser, and that she hall have, possess and enjoy the room in the present dwelling house known and used as a Kitchen, and the adjoining bedroom in the east end of the building, also as much firewood chopped and piled at the door, or in some convenient place, to be ready for use, as will be sufficient fuel for one fire place or stove, and twenty five bushels of potatoes Yearly and every year, also on pair of Boots yearly and every year, during her natural life.

And I do hereby utterly disallow, revoke, and disannul all and every other former testaments, Wills, legacies, bequests, and Executors by me any wise before named. Willed and bequeathed, ratifying and confirming this and no other to be my  last Will and Testament.

I hereby nominate and appoint Hugh Fraser, of the West Branch of East River, in the County of Pictou, and William Fraser my youngest son as Joint Executors of this my  last Will and Testament.

I do hereby certify that the foregoing instrument consisting of two & a quarter pages, is an exact and literal copy of the last Will and Testament of John Fraser, late of the West river, in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou, this 29th day of December A.D. 1880.
