Estate of Donald Fraser, late of Acadia Farm, Esquire, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

I Donald Fraser of Acadia Farm in the County of Pictou, farmer, make and publish this my last Will and Testament.

I give and devise to my son Donald and his heirs and assigns that part of the Acadia farm commonly known as the Murdoch property and which borders at the West on the Carriboo road, and contains about seventy acres together with the buildings thereon said property to be subject to the right of way, over the same where the lane or way now runs from said Carriboo road towards the dwelling house on said Acadia farm.

I give and devise to my son Alexander McGillivray his heirs and assigns the remainder of said Acadia farm containing about one hundred and forty acres with the buildings thereon, and right of way over the land divided to his brother Donald a the place above mentioned, upon the following conditions,

1. That he keeps and supports his mother during the whole of her life.

2. That he keeps and supports Bella H. Fraser on said farm tell she chooses to leave permanently or gets married.

3. That he gives Richard Fraser a common School education, support him while attending School, and gives him a trade and necessary support while learning it.

I give and devise to my wife Catherine the parcel of land and premises situated at Church Street, in the town of Pictou for her life, and at her death I give and devise the same to my son Albert his heirs and assigns.

I give and devise to my son Albert his heirs and assigns the parcel of land known as the Six acre Murdoch lot, near the limits of the town of Pictou, also the parcel of land or twelve acre field at the South side of Second division road leading from Barry's Mills eastwardly.

I give and devise to my wife Catherine all my household furniture and effects, and all my horses, livestock, farm produce, farming implements and chattels on, and connected with my said Acadia farm.

I give and devise to the executors hereinafter named, all my real and personal property of every kind not already disposed of, in trust, to collect all monies and dispose of all property at private or public sale, and with the moneys and proceeds  to discharge two certain debts amounting to about one thousand and fifty dollars and bearing interest, particulars whereof I have given to said executors, and all my other just debts  my funeral and testamentary expenses. If any balance shall remain to pay the same to my said wife, or if she is not living at the time said executors shall be ready to pay over the balance, then to divide the same equally between my children and said Bella H. Fraser and Richard Fraser or such of them as shall then be living.

I appoint my son Alexander Fraser and Charles E. Tanner to be executors of this Will.

I  revoke all  wills and codicils heretofore at any time by me made.

In witness whereof I have hereunto set my hand this fifth day of December in the year of our Lord one thousand Eight hundred and eighty nine, (this will consisting of three pages annexed.)

I do hereby certify that the foregoing instrument consisting of three pages or thereabouts, is an exact and literal copy of the last Will and Testament of Donald Fraser late of Acadia Farm in the County of Pictou,  deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou this 25th day of March A.D. 1890.
