 Certified Copy of Will for the Registrar of Deeds

 Last Will of Archibald Fraser

 In the name of God, Amen.

 I Archibald Fraser of Robertson's Lake Churchville in the County of Pictou and Province of Nova Scotia, Yeoman being in good health and sound in mind and memory do make and declare this to be my last Will and Testament.

 I hereby revoke all former wills by me made.

 1st. I will and request that when it shall please Almighty God to take me hence from this world that my body shall be buried in my lot in the Riverside Cemetery below New Glasgow and a stone monument erected at my grave the expenses to be paid by my executors to be hereinafter mentioned for which purpose I leave at their disposal the sum of one Hundred Dollars.

 

2nd. I will and bequeath unto Sarah W. Fraser, eldest daughter of James Fraser my adoptive son all of that Lot or parcel of Land owned by me and described as follows that is to say situate near Robertson's Lake, and bounded on the west side by a small stream running at the east end of lands owned by James Fraser, on the north by lands of William Forbes, on the east by lands of Duncan J. McKenzie, and on the south by lands of Duncan F. McKenzie and Alexander McKenzie. Provided always that if James Fraser my adopted son will pay to her the said Sarah W. Fraser the sum of          

     

I also bequeath to the said Sarah W. Fraser my red chest and a bed Sack with as much clothing as will furnish one bed.

 

3rd.

3rd.  I will and bequeath unto Isabella Janet Fraser second daughter of James Fraser my adopted son, the sum of One Hundred Dollars to be paid to her when she becomes the full age of eighteen years.


 

4th. I will and bequeath unto Margaret Ann Fraser third daughter of James Fraser my adopted son the sum of eighty Dollars to be paid to her when she becomes the full age of sixteen years.

 5th. I will and bequeath and order that if any of the above named devisees daughters of James Fraser shall die before the above bequests are paid to her or them, then the sum or sums herein bequeathed to her or them shall be paid in equal amounts to her surviving sisters or in case only one survives then she shall receive the amount herein bequeathed to her deceased sisters.

 6. I will and bequeath unto Mrs. Sarah Dand of New Glasgow the sum of Forty Dollars.

 7th. I will and bequeath unto Fanny Fraser daughter of James Fraser (ogg) of New Glasgow, the sum of Twenty Dollars.

 8th. I will and bequeath unto Catherine, Margaret and Mary Fraser, my nieces daughters of William Fraser Ogg of New Glasgow the sum of Sixty Dollars to be divided equally among them and if any of them doe before this bequest is paid the it will be divided between those who may be living of the three sisters abovenamed.

 9th. I will and bequeath unto William Fraser (ogg) my nephew the sum of Twenty Dollars.

 10th. I will and bequeath unto James Fraser, my adopted son all of my Farming implements household furniture and utensils, also the use and possession of the herein above described Lot of Land untill such time as the abovenamed Sarah W. Fraser will become the full age of eighteen years.

 I also bequeath to the said James Fraser, the sum of Forty Dollars to assist in defraying my funeral expenses and also the expenses of executing this my last Will and Testament.

 11th. I will and bequeath unto Angus McMillan of Finners Mount Thom the sum of Twenty Dollars.

 12th. I will and bequeath unto Mrs. Sarah Dand of New Glasgow all the residue and remaining part of my property.

 13th. And lastly, I nominate and appoint and ordain James Fraser my adopted Son and Angus McMillan of Finners Mount Thom to be Sole executors who shall pay all my just debts, collect all monies due me and invest for the benefit of the devisees the sums bequeathed to Isabella Janet Fraser and Margaret Ann Fraser and take charge of the said sums untill the said devisees become of the full age hereinabove mentioned and also see this my last will duly executed.

Signed asnd declared by me to be my last will and Tesament in the presence of the Subscribing withnesses this fourth day of July in the year of our Lord One thousand and eight hundred and Seventy eight.

 I do hereby certify that the foregoing instrument consisting of three pages, is an exact and literal copy of the last Will and Testament of Archibald Fraser late of Churchville in the County of Pictou, Yeoman, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

 Given under my hand at Pictou this 27th day of February A.D. 1883.
