 Estate of Nicholas Balfour, late of Middle River, Farmer deceased, Testate

 Certified Copy of Will for the Registrar of Deeds

 In the name of God, Amen.

 This is the last Will and Testament of me, Nicholas Balfour of Middle River in the County of Pictou, and Province of Nova Scotia, Farmer.

 (1st.) I devise to my son William Balfour the sum of Twenty five cents.

 (2nd.) I devise and bequeath to my son James Balfour my share in Mills and Millsite on Middle River upon the following condition viz -

 that he pay or cause to be paid to my daughter Catherine Balfour Sixty Dollars within one year from my death. If said amount is not paid in the time specified, Then my said daughter Catherine will become Heir to all my claim and share in above mentioned Mills and Mill site.

(3rd.) I devise and bequeath to my son Duncan Balfour the sum of Twenty five cents.

 (4th.) I devise and bequeath to my daughter Nancy McLeod Twenty five cents.

 (5th.) I devise and bequeath to my son David Balfour the sum of twenty five cents.

 (6th.) I devise and bequeath to my daughter Janet Munro, Twenty five cents.

 7th. I devise and bequeath to my wife Jannet Balfour a Home on the property on which I now reside as long as she lives, to occupy the rooms which I(8th.) I devise and bequeath to my Daughter Catherine Balfour the abovementioned live stock - should she my wife survive to come in possession of the same at my wife's death, also all my personal property viz - Household furniture beds and bedding** also that she may be provided at the death of my wife should she survive with two small rooms and kitchen on the ground floor of the house in which I(9th.) I devise and bequeath to my grandson John David Balfour all the real estate which I may be possessed at the time of my death and which I have hereinbefore devised, To Have and to hold the same unto him the said John David Balfour his Heirs and assigns for ever. upon the following conditions, that is to say -

 That he will pay my just debts at the time of my death, and also that he will pay over to the several parties mentioned in this will, the sums intended for them also that he will fulfill the Conditions of this will as regards Jannet Balfour, and Catherine Balfour. If the said John David Balfour refuses to become my heir under the above conditions, then he forfeits all claims to the above mentioned real estate, and Alexander N. Balfour is appointed by me to be my heir under the same conditions. Either of the last mentioned parties will require to give security to be approved of by my executors for the fullfillment of the above conditions. If both of the above mentioned parties reuse to become my heir, then I will and devise all my real Estate as above mentioned, to my daughter Catherine Balfour.

 (10th.) I appoint my son Duncan Balfour as Guardians of my Daughter Catherine Balfour.

 (11th.) I do hereby nominate and appoint my son Duncan Balfour and my Friend Thomas H. Munro to be Executors of this my last will and testament.

 In testimony whereof I the testator have hereunto set my hand and Seal this Fourth day of October A.D. 1882..

 I do hereby certify that the foregoing instrument consisting of three pages, is an exact and literal copy of the last Will and Testament of Nicholas Balfour late of Middle River, in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

 Given under my hand at Pictou, this first day of September A.D. 1895.
