Will of Kenneth Ferguson, deceased
Certified Copy for Reg of Deeds
Know all men by all these presents that I Kenneth Ferguson of Glace bay in the County of Cape Breton and Province of Nova Scotia Merchant being of sound and disposing mind and memory do make and publish this my last will and testament, revoking any former wills by me at any time heretofore made.
My will is that my executors hereinafter named shall as soon after my decease as possible sell and convey my real estate and personal property and effects of every kind and nature whatsoever to do all of which full authority as hereby given and shall distribute the proceeds thereof as follows to wit-- three fourths of the amount realized shall be expended in the purchase of a life annuity in some good Company for my daughter Bertha M Ferguson,
the remaining fourth part to be divided equally between the following named persons, my son Fred. A. Ferguson, my niece Mrs. Richard Sounth of Charlottetown P.E. Island, my niece Mrs. Arthur W Tauton of Southport P.E. Island, my sister Mrs. Catherine McDonald of Belfast P.E. Island and Mrs. Frank Ferguson of the 48 P.E. Island, providing this my will is not contested and duly probated. The lots of land given by my son Fred. A. Ferguson for money loans and goods provided all both to be considered as part of my estate and to be handed over to him but in case of a contest he the said Fred. A. Ferguson is not to benefit under the will.
The balance of my estate consisting of monies on deposit and interest in Banks is to remain where it is for ten years the interest each year added to the principal at the expiration of ten years the money to remain in Banks and the accruing yearly interest to be distributed as follows, one fourth to be paid to my son Fred. A. Ferguson, one fourth to my daughter Bertha M. Ferguson, one fourth to Doctor Roy son of James Roy Town Clerk and one fourth to J. Frederick McDonald in trust for his heirs, should either of the above person decease then share to go to their heirs.
I appoint Angus MacDonald of West River Station, Farmer, and Kenneth F. my friend James Roy Town Clerk of New Glasgow, N. S. and my friend J. Frederick McDonald of New Glasgow, N.S. Gentleman joint Guardians of my daughter Bertha M. Ferguson.
I appoint my friend the said James Roy and my friend the said J. Frederick McDonald executors and Trustees of this my last Will and Testament.
In testimony whereof I the said Kenneth Ferguson have hereunto subscribed my name and set my hand and Seal to this my last Will and Testament this third day of November in the year of our Lord one thousand nine hundred and two

I the within named Kenneth Ferguson at this date of New Glasgow in the County of Pictou do make this my last Codicil hereby confirming my last will and Testament made on the third day of November in the year of our Lord one thousand nine hundred and two so far as this Codicil is considered therewith,
and I do hereby annul the provisions as therein made in so far as they relate to my daughter Bertha May Ferguson and subscribed as follows that is to say-
I give devise and bequeath to my daughter Bertha May Ferguson the sum of one thousand Dollars. In witness whereof I the said Kenneth Ferguson have hereunto and set my hand and Seal to this my Codicil at said New Glasgow this thirtieth day of October in the year of our Lord one thousand nine hundred and three

The said Kenneth Ferguson at said New Glasgow on said thirtieth day of October AD 1903 Signed and Sealed this instrument as and for his last Codicil to his last Will and Testament and we at his request and in his presence have signed our names as witnesses and in the presence of each other the same having been first read over in our hearing and presence to the said Kenneth Ferguson and apparently understood by him.

McLeod Registrar of said Court do hereby certify that the foregoing paper writing is a true and correct copy of the last Will and Testament of Kenneth Ferguson late of New Glasgow in the County of Pictou deceased which said will was duly admitted to Probate in said Court at Pictou on the twentieth day of November AD 1903
