Will of John Connolly, deceased
Certified Copy for Reg of Deeds
THIS IS the last will and Testament of me, John Connolly of New Glasgow, in the County of Pictou, Coal Dealer, I hereby revoking all former Wills.
1. I direct my said executors to pay all my just debts, funeral and Testamentary expenses be paid and satisfied by my executors hereinafter named, as soon as conveniently may be after my decease.
2. I give, devise and bequeath to my niece Teresa Connolly One Hundred and Fifty Dollars.
3. I give, devise and bequeath to my niece Annie Walsh One Hundred and Fifty Dollars
. 4. I give, devise and bequeath to the Roman Catholic Church Extension Society of Canada, One Hundred Dollars.
5. I give, devise and bequeath all my real estate of every kind and wherever situated, and all my personal estate and effects whatsoever unto my Executors and Trustees hereinafter named, their and each of their heirs, executors and administrators, respectively, according to the nature thereof: UPON TRUST, that my Executors and Trustees shall sell, call in and convert into money the same or such part thereof as shall not consist of money, and shall invest, deposit and distribute the same in the manner hereinafter ordered and directed.
6 I order and direct that my Executors and Trustees invest the sum of Ten Thousand Dollars in such investments and securities as are permitted by "The Trustee Act" Revised Statutes of Nova Scotia, 1900, chapter 151, and the Acts in Amendment thereof, and keep the same invested as aforesaid, during the term of the natural life of my wife, Selina H. Connolly, or so long as she remains my widow, and I further order and direct that the interest or dividends on the said sum of Ten Thousand Dollars so invested, be paid semi-annually to my said wife, Selina H. Connolly, during the term of her natural life or so long as she remains my widow. Upon the death of my said wife Selina H. Connolly, or upon her re-marrying, I order and direct that the said sum of Ten Thousand Dollars be divided equally among my three Note: each page is signed (Sgd.) by John Connolly and initialed E.B.S. and R.G. McK. children, John B. Connolly, Mrs. Nellie Donovan and Mrs. T. Howard MacDonald, share and share alike.
7. I hereby declare that the provision made for my said wife Selina H. Connolly, in paragraph 6 of this my last Will and Testament is made in lieu of all her interest whether by way of dower or otherwise in my property and estate.
8. I order and direct that my Executors and Trustees invest the sum of Two Hundred Dollars in such investments and securities as are permitted by "The Trustee Act" Revised Statutes of Nova Scotia, 1900, chapter 151, and the Acts in Amendment thereof, and that the said Two Hundred Dollars be kept invested as aforesaid for the period of Twenty years after my decease; and I order and direct that the interest or dividends on the said sum of Two Hundred Dollars be used by my Executors and Trustees for the maintenance and proper care of my family lot in the cemetery at Lourdes in the County of Pictou. Upon the expiration of the said period of Twenty years after my decease I order and direct that the said sum of Two Hundred Dollars be divided equally between my two grandchildren, Nora Donovan and Carroll Donovan share and share alike.
9. After the payment of the bequests made in paragraphs 2, 3 and 4, and after the investments directed to be made in paragraphs 6 and 8 of this my last Will and Testament are made, I order and direct that all the rest, residue and remainder of the money belonging to my estate, whether it consists of money realized from the sale of my property and estate, cash on hand, or otherwise, be equally divided among my three children, John B. Connolly, Mrs. Nellie Donovan and Mrs. T. Howard MacDonald, share and share alike.
10. I hereby nominate, constitute and appoint my said son John B. Connolly and my Son-in-law, T. Howard MacDonald, to be the Executors and Trustees of this my last Will and Testament.
IN WITNESS WHEREOF I have hereto my hand and seal subscribed and set at New Glasgow in the County of Pictou, this nineteenth day of June A.D. 1911.
