In the Name of God Amen!!!
I Floyd Dunbar of Scotch Hill county of Pictou and Province of Nova Scotia being of tolerable state of health, and of Perfect mind and memory, thanks be given unto God; but calling unto mind the mortality of the body, knowing that it is appointed unto all men once to die, do make and ordain this my last will and testament; that is to say, principally and first of all, I give and recommend my soul into the hands of almighty God that gave it, and my body I recommend to the earth, to be buried in decent Christian burial, at the discretion of my executors; nothing doubting but at the general resurrection I shall receive the same again by the almighty power of God - And as touching my worldly estate I recollect that I did sign a Deed of fifty acres of my land to William my son, which was contrary to my firm resolution for several years past, For my meaning and intention was to give William the whole of my real property. He after my decease on condition that he would perform his duty to his mother and sisters in form hereafter mentioned. Therefore I do make herein two propositions, and my order and will is that the first proposition shall be only in force if William will accept of the conditions thereof. First it is my order and will that William my son will relinquish his claim of the contents of the Deed which he obtained of me ad let it stand null and void, then I give and bequeath to the said William my son the whole of my real property in Scotch Hill, the whole of my farming implements, the half of my dwelling house, the half of my household furniture, and the half of my personal property or moveable effects, on condition that the said Willm will give to Isabell my beloved wife the third part of the yearly produce of my property (meaning my original property) during her term of life, to whom I give and bequeath the half of my house, the half of my house-hold furniture, and the half of my moveable effects, freely to hofsefs (“possess”) during term of life with full power to distribute what she may have at her decease among her own children according to their duty to herself; and also that he shall mention his three sisters the same as they are while they choose to stay along with him only they shall have to work with him for the same when able to do so, when they choose to leave him then he shall give his two sisters Peggy and Bell, twelve pounds cy. (?) a piece, and five pounds to Betsy – on performing the said conditions the said William shall enjoy the above bequests for himself heirs and afsigns (“assigns”) forever- But if so be that William my son will not comply with the first proposition of my last will and testament nor fulfill the conditions thereof, I then do make and ordain this my Second proposition in manner following, that is to say I give and bequeath to Isabell my beloved wife the whole of my present real property on Scotch Hill, also my farming implements, my household furniture, the whole of my moveable effects ? and the sixty pounds William has to pay for his fifty acres of land pofsefs (“possess”) during her life time and giving her full power to give and dispose of what remains of the same at her decease among her own children as she then think proper as according to their merit and duty to herself. I give and bequeath to each of my two daughters Peggy and Bell twelve pounds. I give and bequeath to Betsy my daughter five pounds - I give and bequeath to William my son for ever one shilling, because he got his fifty acres of land at least ninety pounds under value.
Anything that may be in need of settling or arranging I leave it to the discretion of my executors to settle it as it seems to them in their wisdom deem meet. I likewise hereby nominate appoint and constitute, my trusty friends Mefsrs (“Messrs”) William McKay West Branch River John and George McKay of Mount Thom executors of this my last will and testament – And do hereby utterly disallow, revoke, and disannul, all and every other former testaments, wills, legacies, bequests, and executors, by me in anywise before named, willed, and bequeathed, ratifying and confirming this and no other, to be my last will and testament.
Testament In witnefs (“witness”) whereof I have hereunto set my hand and seal, this fifth day of August in the year of our Lord one thousand and eight Hundred and forty.
