This Indenture made the twenty fifth day of August in the year of our Lord one thousand eight hundred and twenty nine Between James Roddick of Carriboo in the District of Pictou Miller of the one part and William George Cochran of Halifax in the County of Halifax Esquire of the other part Witnesseth that the said James Roddick for and in consideration of the sum of twenty five pounds seventeen shillings and six pence of lawful money of Nova Scotia to him in hand by the said William George Cochran well and truly paid the receipt whereof hereby acknowledged Hath granted bargained sold enfeoffed released and confirmed and by these presents Doth grant bargain sell enfeoff release and confirm unto the said William George Cochran his heirs and assigns All that certain lot piece or parcel of land situate lying and being at Carriboo in the District of Pictou aubtted and bounded as follows: to wit Beginning at the Shore on the South side of Carriboo Harbor at the North West angle of lot No. 55 as laid down on a plan made by Messrs Millar and McLean thence running South ninety eight chains or to the rear line of the front division of lots on said Harbor thence West twenty six rods thence North one hundred and eleven chains to the Harbor aforesaid thence North Easterly the several courses of the shore to the place of beginning containing sixty nine acres more or less together with all and singular the houses out-houses barns stables buildings ways waters water courses easements commodities privileges and appurtenances to the said lot piece or parcel of land belonging or in anywise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and also all the right title estate interest claim property and demand of him the said James Roddick which he now hath or here after may have to in or upon the same To have and To hold the said lot piece or parcel of land and premises with the appurtences unto the said William George Cochran his heirs and assings to his and their own proper use benefit and behoof forever Provided always and it is the true intent and meaning of the parties to these presents that if the said James Roddick his heirs executors administrators or assigns do and shall well and truly pay or cause to be paid unto the said William George Cochran his executors administrators or assigns the full principal sum of twenty five pounds seventeen shillings and six pence of lawful money of Nova Scotia with lawful interest from the date hereof by instalments that is to say the sum of five pounds three shillings and six pence with interest from the date hereof on the twenty fifthy day of August next the further sum of five pounds three shillings and six pence with interest from the date here of on the twenty fifth day of August in the year of our Lord one thousand eight hundred and thirty one the further sum of five
five pounds three shillings and six pence with interest from the date hereof on the twenty fifth say of August which will be in the year of our Lord one thousand and thirty two the further sum of five pounds three shillings and six pence with interest from the date hereof on the twenty fifth day of August which will be in the year of our Lord one thousand eight hundred and thirty three And the further or remaining sum of five pounds three shillings and six pence with interest from the date hereof on the the twenty fith day of August which will the be in the year of our Lord one thousand eight hundred and thirty four in manner and form as the same is secured to be paid to the said William George Cochran by the said James Roddick by a certain bond or obligation from the said James Roddick to the said William George Cochran and bearing even date hereinth without fraud or further delay then these presents and every matter clause and thing therein contained shall cease and become absolutely void. And the said James Roddick for himself his heirs executors and administrators and assigns doth by these presents grant covenant promise and agree to and with the said William George Cochran his executors administrators and assigns in manner and form following that is to say that he the said James Roddick his executors and administrators shall and will well and truly pay or cause to be paid unto the said William George Cochran his executors administrators or assigns the said sum of twenty five pounds seventeen shillings and six pence of lawful money of Nova Scotia with lawful interest for the same on the days and at the times herebefore and also in the said bond or obligation limited and appointed for payment thereof And also that he the said James Roddick hath good rightful powere and lawful authority to grant sell and convey the said lot piece or parcel of land and premises with the appurtances in manner and form as the same are herein and hereby granted sold and conveyed and that if default shall happen to be made in payment of the said sum of twenty five pounds seventeen shillings and six pence in manner and form aforesaid then it shall be lawful for the said William George Cochran his executors administrators and assigns to enter into have hold use occupy possess and enjoy the said lot-piece or parcel of land and premises with the appurtances without the lawful let hindrance interruption or denial of any person or persons whomsoever In Witenss whereof the parties to these prents have hereunto set their hands ad seals the day and year first above and before written

I the within named William G Cochran Do hereby certify that the full amount due for principal and interest or the within mortgage has been fully paid to me by the within name James Roddick. These are therefore to authorize and require you enter ---of the said mortgage pursuant to the estate in such --- made and provided in witness whereof the said William G Cochran by Charles Twining his attorney has hereunto set his name this twenty first day of October AD 184-
