Description Deed Annie Foster to William Ferguson

This indenture made the twenty ninth day of March in the year of our Lord one thousand eight hundred and eighty two Between Annie Foster of Pictou in the County of Pictou and Province of Nova Scotia Widow of Charles Foster lots of the same place master Mariner deceased of the one part and William Ferguson of Pictou aforesaid Builder of the other part

Witnesseth that for an in consideration of the sum of six hundred and thirty eight dollars and thirty five cents to her in hand well and truly paid by the said William Ferguson at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged she the said Annie Foster hath granted, bargained, sold, aliened, remised, released, enfeoffed, conveyed and confirmed and by these presents Doth grant bargain, sell, alive, esquire, release, enfeoff, convey and confirm unto the said William Ferguson his heirs and assigns all that certain lot piece or parcel of land situate lying and being in the Town of Pictou and abutted bounded and described as follows. Beginning on the North side line of Pleasant Street at the Southeast corner of lot number sixteen on a place of building lots, at the east end of the Town of Pictou, owned by our John Logan and running thence easterly along the North side line of Pleasant Street at the Southeast course of lot number sixteen on a place of building lots, thence northwardly along the west side line of said lot number eighteen one hundred and twenty feet to the northwest corner thereof thence westward parallel with said Pleasant Street fifty eight feet and thence southerly parallel to the west side line of said lot number eighteen one hundred and twenty feet to the place of beginning said described lot being marked and numbered at lot number seventeen on said Place of building lots together with all and singular the houses buildings ways waters, watercourses, easements, privileges and appurtenances  and the reversion and reversions, remainder and remainders rents, issues, and profits thereof and also all the estate right, title, interest, property line claim and demand both at law and in equity of her the said Annie Foster of in to or the same. To have and to hold the said lot of land and premises with the appurtenances and every part thereof unto the said William Ferguson his heirs and assigns forever.

Provided nevertheless that it is the true interest and wearing of these present and of the parties hereto that if the said Annie Foster his heirs executors administrators or assigns do and shall well and truly paid or cause to be paid to the said William Ferguson his executors administrators or assigns the just and full amount six hundred and thirty eight dollars of lawful money of the dominion Of Canada with interest thereon in manner and form following; that is to say the said full principal sum of six hundred and thirty eight dollars of lawful money as aforesaid in one year from the date hereof with interest thereof at the rate of six percent per annum payable annually, being the same sum of interest as is made payable to the said William Ferguson in and by the certain possession of the said Annie Foster made bearing date herewith these presents to be and because well and void otherwise to be and remain in full force and virtue And the said Annie Foster for herself her heirs executors and administrators doth hereby covenant promise and agree to and with the said William Ferguson his heirs executors and administrators sin manner and form following that is to say: that she the said Annie Foster her heirs executors or administrators shall and will well and truly pay or cause to be paid to the said William Ferguson his executors adjustors or assigns the said full sum of six hundred and thirty eight dollars and thirty five cents and the interest, thereon of the day and twice after the rate and in the manner mentioned in the foregoing proves that the said Annie Foster at the time of executing these presents is and stands seized and passed of a good and sufficient estate of inheritance in fee simple of an in the lot of land and premises with the appurtenances hereinbefore descried and conveyed and that she ahs good right full power and lawful authority to grant and convey the same in manner and form as the same Is hereinbefore granted and conveyed and that she has good right full power and lawful authority to grant and convey the same in manner and form as the same is hereinbefore granted and conveyed and that she and her heirs the said lot of land and privileges with the appurtenances and every part thereof unto the said William Ferguson his heirs and assigns shall and will by these presents warrant, maintain, and forever defend, And also that she the said Annie Foster her heirs executors or administrators shall and will keep and or wake of the building on the said untagged premises insured in source good fie insurance company to the selected by the said William Ferguson for the sum of five hundred dollars for the benefit of the said William Ferguson his executors, administrators or assigns as long as the said sum of five hundred dollars and the interest thereas or any part thereof remains due as unpaid and shall deposit with the said William Ferguson all policies and renewal receipts canceled with such insurance and that in default thereof, that it shall be lawful for the said William Ferguson to issue the same as aforesaid and to make the premises payable thereon with the interest at six percent a further change on the said mortgage demises.

In witness whereof the said parties to these presents have hereunto their hands and seals subscribed and set the day and year first hereinbefore written.
