Description Deed Simon Holmes to Pictou Publishing Company

This indenture made this thirty first day of March in the year of our Lord one thousand eight hundred and eighty four, Between Simon H. Holmes of Halifax in the county of Halifax gentleman and Isabella his wife of the one part, and the Pictou Publishing Company a body corporate and polite incorporated under the Nova Scotia stock companies Act 1883 of the other part.

Witnesseth that the said Simon H. Holmes and Isabella his wife in consideration of the sum of two thousand five hundred dollars of lawful money of Canada to the said Simon H. Holmes in hand well and truly paid by the Pictou Publishing Company aforesaid at or before the ensealing and delivery of these presents the receipt whereof as hereby acknowledged have and each of them hath granted bargained sold, aliened enfeoffed released remised conveyed and confirmed and by these presents do and each of them doth grant, bargain, sell, alien, enfeoff, release, remise, convey, and confirm unto the Pictou Publishing Company aforesaid their successors and assigns all that lot piece or parcel of land situate and being on the south side of water street in the town od Pictou and bounded and described as follows: beginning on the east side line of Market Street at the south west angle of  a lot sold by John Miller of Liverpool to Alexander Patterson thence running southwardly along the east side line of said Market Street twenty feet thence eastwardly at a right angle fifty feet or until it comes to the western side line of William Gordon’s lot (formerly) thence northwardly along the western side line of said Gordons lot twenty feet or until it comes to the south east angle of Alexander Patterson’s  lot aforesaid and thence westwardly along the said line of said Patterson’s lot fifty feet or to the place of beginning; being the lot of land conveyed to said Simon Holmes by James Murdock and wife by deed dated seventeenth October A.D. 1861 and Registered at Pictou in book forty eight page 5-19, together with all and singular the houses, outhouses, barns, buildings, ways, waters, watercourses, easements, privileges and the reversion and reversions, remainder and remainders rents, issues, and profits thereof and also all the estate right title interest claim property and demand both at law and in equity of them the said Simon Holmes and Isabella his wife of in to or out of the same or any part thereof also with the permitting presses, boiler, type and other permitting, plant situate and being, in and upon said described premises; and the colonial standard newspaper and the business and good will thereof To have and to hold the said Law and premises, and the said printing presents boiler type and other printing and the said Colonial Standard newspaper, and the business and good will thereof, with the appurtenances and every part thereof unto the Pictou Publishing Company aforesaid their successors and assigns to their sole use benefit and behoof forever.

And the said Simon Holmes doth hereby for himself his heirs executors and administrators grant covenant promise and agree to law with the Pictou Publishing Company aforesaid their successors and assigns in warren following that is to say: that it shall and way be lawful for the Pictou Publishing Company aforesaid their successors and assigns from time to time and at all times hereafter peaceably and quietly to enter unto the said land and premises and to have to occupy possess and enjoy the same without the lawful let hindrance eviction dismal or disturbance or from or by the said Simon Holmes or Isabella his wife or any person or persons whomsoever lawfully claiming or to claim the same. And also that the said Simon Holmes and Isabella his wife have or one of them hath a good sure perfect and wide feasible estate on inheritance in fee simple to the said law and premises and have or hath good right full power and lawful authority to sell and convey the same in and force and they are hereby sole and conveyed or mentioned or indented to be and lastly that the said Simon Holmes and his heirs the said land and premises and other property hereinbefore described and conveyed, and every part thereof unto the Pictou Publishing Company aforesaid their successors and assigns against the lawful claims of all persons whomsoever shall and will by these presents warrant and forever defend.

In witness whereof the parties to these presents to have hereto their hands and seals set and affixed on the day and year first above written.

Signed sealed and delivered in presence of the word “March” on second line and word “four” or fourth line of first page being subscribed for “December” and “three” respectively scored out before execution also the undo “and property” time written on the second page hereof being scored out.
