Description Deed John Henderson to Alexander Henderson

This indenture made this Twenty seventh day of October in the year of Our Lord one thousand eight hundred and twenty five. Between John Henderson of Cape John district of Pictou County of Halifax and Province of Nova Scotia, Yeoman and Janet his wife of the one part, and Alexander Henderson of Cape John and Province aforesaid Yeoman of the other part. Witnesseth that the said John Henderson for and in consideration of the sum of fifty pounds current money of Nova Scotia to him in hand well and truly paid at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged. Hath granted, bargained, sold, remised, released, enfeoffed and confirmed and by these presents doth, grant, bargain, sell, remise, release, enfeoff and confirm unto the said Alexander Henderson his heirs and assigns a certain tract or lot land situate lying and being in the second division of lots in Cape Jon aforesaid and is abutted and bounded as follows. Beginning on the East side of a certain Duncan MacColl lot Four chains fifty links from the North eastern angle of said MacColls lot thence fifty five degrees east forty chains to the farm lot of a certain John MacKenzie thence South thirty five degrees west, fifty chains to the land of a certain Stephen Crest, thence North fifty five degrees west forty chains, thence North thirty five degrees East fifty chains to the place of beginning, containing two hundred the same more or less with all and singular the building improvements ways, waters, watercourse, rights, privileges and appurtenances thereof, or thereto in any way appertaining or belonging with the reversion and reversions remainder and remainders rents, issues, and profits thereof with the estate, right , title, interest claim property and demand of the said John Henderson of in and to the same in as full and ample a manner as the said John Henderson is now entitled to, to have and to hold said lot of land and premises to him the said Alexander Henderson his heirs and assigns forever and the said John Henderson for himself his heirs his executors administrators and assigns, doth, by these presents, grant, convey, and agree to and with the aid Alexander Henderson his heirs and assigns in manner and form following served in his own right of a good and sufficient estate of inheritance in fee simple of and in the said land and premises and that he will warrant maintained and defend the same against the lawful claims or demands of any person or persons claiming the same or any part thereof to him the said Alexander Henderson his heir and assigns forever and Janet Henderson wife of the within named and designed Henderson doth in and by these presents remise release and forever make over unto the said Alexander Henderson all the right title interest claim and demand which she now hath or ought to have in to and upon the before described premises in right od dower or otherwise.

In witness whereof the parties to these presents have hereunto their hands and seals subscribed and set the day and year fist above written.

Received on the day of the date of the foregoing indenture from the therein named Alexander Henderson the sum of fifty pounds currency being the full consideration money therein mentioned.

On this fifteenth day of September one thousand eight hundred and twenty eight personally appeared before me the subscriber one of his majesty’s of the peace for the county of Halifax Janet Henderson who being by me examined separate and apart from her said husband declared that she signed and executed the foregoing indenture for the purposes therein contained of her own free will and accord and not by or through any force or compulsion from her said husband or any other person or persons thereby remise and released to the said Alexander Henderson the claim interest and demand which she now hath to have in and to the land and premises within described in rights to have in and to the land and premises within described in right of dower or otherwise in my capacity aforesaid thereby certify.
