Description Deed James D.B. Fraser to Henry Cameron

This indenture made this fifteenth day of May in the year of our Lord one thousand eight hundred and forty five. Between James D.B. Fraser of Pictou in the County of Pictou Esquire and Christy Ann his wife of the one part and Henry Cameron of West River of Pictou in the county aforesaid Tailor of the other part witnesseth that in consideration of the sum of ninety pounds of lawful money of Nova Scotia to him in hand paid by the said Henry Cameron at or before the executors of these presents the receipt whereof is hereby acknowledged. They the said James D.B. Fraser and Christy Ann his wife have and each of them hath granted bargained sold aliened, remised released enfeoffed and confirmed and by these presents do and each of them Doth grant bargain sell, remise, release, enfeoff and confirm unto the said Henry Cameron his heirs and assigns all that contain fit piece or parcel of land situated lying and being on the west side of the West River of Pictou and abutted and bounded as follows. Beginning five feet south west corner of Alexander McDonald’s house thence to run North thirty eight degrees west by the Magnet one hundred and ninety eight feet thence fifty two degrees west fifty two feet thence south thirty eight degrees east one hundred and ninety eight feet until it meets the highway thence along the said highway fifty three feet until it meet the place of beginning being marked on a certain plan of lot as NO 1 containing in the whole eleven hundred and sixty sum square be the same more or less together with all the houses outhouses buildings, improvements, privileges and appurtenances to the said lot piece or parcel of land belonging or in anywise appertaining and the reversion and reversions remainder and reminders rents issues and profits thereof and also all the estate right title interest property claim and demand both at law and in equity of him the said James D.B. Fraser and all the dower or thirds or right or title to dower to thirds of her the said Christy Ann Fraser his wife into out of or upon the said lot piece or parcel of land and premises above granted or any part thereof. To have and to hold the said lot piece or parcel of land and premises hereby granted and conveyed or mentioned or indentured so to be with their and every of their appurtenances unto him the said Henry Cameron his heirs and assigns to his and the in only proper and absolute use benefit and behoof forever and the said James D.B. Fraser doth hereby for himself his heirs executors administrators covenant promise and agree to and with the said Henry Cameron his heirs executors administrators and assigns in manner and form following that is to say that at the time of executing these presents be the said James D.B. Fraser as and stands seized of an absolute estate of inheritance in fee simple of and in the said lot piece and parcel of land hereby granted and conveyed or intended so to be in any condition or incumbrance whatsoever and that he hath good right full power and lawful authority to sell and convey the same in manner and form as they are herein and hereby granted and conveyed or mentioned intended so to be and also that he the said James D.B. Fraser and his heirs the said lot piece or parcel of land and premises above granted to the said Henry Cameron his heirs and assigns against the lawful claims and demands of all and every person and persons whatsoever will warrant and maintain and forever defend by these presents.

In witness whereof the parties to these presents have here  unto these hands and seals subscribed and set the day and year first above written.

Signed, sealed and delivered in the presence of David Matheson and George McRay

Received on the day of the date of the year foregoing Indenture from the therein named Henry Cameron the sum of Ninety pounds of lawful money of Nova Scotia being the consideration money in full therein mentioned to be paid by him to me.

On this seventeenth day of May in the year of our Lord Eighteen hundred and forty five personally before me the subscriber one of Her majesty’s justices of the peace for the county of Pictou Mrs. Christy Ann Fraser party to the foregoing indenture and wife of James D.B. Fraser party to the foregoing indenture and wife of James D.B. Fraser also party thereto who being examined separate and apart form her said husband acknowledged that the said indenture was by her executed freely and voluntarily for the purposes therein set forth and contained and without any force or compulsion from her said husband.
