Description Deed James Dunbar to Alexander Dunbar

This indenture made the first day of August in the year of our Lord one Thousand eight hundred and thirty five between James Dunbar of the West Branch of the East River of Pictou District of Pictou, County of Halifax and Province of Nova Scotia Yeoman of the one part and Alexander Dunbar of the same place yeoman of the other part. Witnesseth that the said James Dunbar for an in consideration of the sum of sixty pounds of lawful money of the province aforesaid to him in hand paid at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged, Hath sold, bargained, aliened, enfeoffed, conveyed, granted and confirmed and by these presents doth sell, bargain, alien, enfeoff, convey, grant, confirm unto the said Alexander Dunbar his heirs and assigns all that certain tract or lot of land situate lying and being on the west side of the West Branch aforesaid, and is abutted and bounded as follows (to wit) beginning at the lower boundary of the lot now owned and occupied by said Alex Dunbar from thence to un North seventy five degrees west along, the lower line of said lot of land four hundred rods or to a lot granted a certain James Cameron, thence North fifteen degrees east along said lot twenty rods or to unmarked tree, thence south seventy five degrees East, four hundred rods or to said West Branch and thence up the shore by the lands to the place of Beginning containing fifty acres more or less being a part of the lot needed had to said Deed for courses and distances, with all and singular the house and houses , barns, stables, ways, waters, watercourses, woods, commodities, hereditament, hereditaments, with the reversion and reversions, remainder and remainders and rents, issues, and profits thereof together with all the estate right, title interest claim property and demands of him the said James Dunbar which here now hath or hereafter may have in to or upon the said described lands and premises or any part thereof to have and to hold the said described lands and premises with the appurtenances to him the said Alexander Dunbar his heirs and assigns to his and their purpose use and benefit and behoof forever. And the said James Dunbar doth for himself his heirs executors and administrators hereby covenant and agree to and with the said Alexander Dunbar. His heirs executors, administrators and assigns in manner and form following that he the said Alexander Dunbar his heirs and assigns may at any time and at all times hereafter enter into have, hold, occupied and enjoy the said lands and premises with the appurtenances in a quietly peaceably manner, witherout let eviction or disturbance from him the said James Dunbar or from any other person from or under him lawfully claiming the same or otherwise be, and that he the said James Dunbar and his heirs, the land and premises above and before described unto the said Alexander Dunbar his heirs and assigns will forever warrant and defend by these presents.

In witnesses where of the said James Dunbar and Anne his wife to these presents set their hands and affixed their seals and day and date as above and before written.

Signed, sealed and delivered in the presence of Alex McKenzie and William Fraser

Received from the within named Alexander Dunbar the sum of sixty pounds being in full the consideration money before mentioned- James Dunbar

Personally appeared before me the subscriber one of his majesty’s justices of the peace, for the district of Pictou Anne wife of the within named James Dunbar who being by me examined separate an apart from her said husband acknowledged that she signed the forgoing deed and also seals it, of her own fee will and record without any hesitation or compulsion from her said husband and that she did thereby remise, release and forever quit claim of the premises therein described as regards down or otherwise.
