Description Deed James Grant to Donald Cameron

This indenture made this twenty second day of May in the year of our Lord one thousand eight hundred and forty eight. Between James Grant and Elizabeth Grant his wife of West Branch East River in the  County of Pictou and Province of Nova Scotia of the one part and Donald Cameron of said West Branch in the County and Province aforesaid of the other part yeoman Witnesseth that the said James Grant and the said Elizabeth Grant his wife for an in consideration of the sum of fifty pounds lawful money of the province aforesaid to them in hand paid by the said Donald Cameron before the ensealing and delivery of these presents the Receipt whereof is hereby acknowledged, hath, granted, bargained, sold, aliened, enfeoffed, conveyed and confirmed and by these presents doth grant, bargain, sale, alien, enfeoff, convey and confirm with the said Donald Cameron his heirs and assigns forever all that certain tract parcel or lot of land situate lying and being on the west Branch aforesaid and which is abutted and bounded as follows, that is to say beginning at the south east angle of lands of John Grant Mason and Running from thence on the line of the said land south fifteen degrees west, forty two, roads or until it comes to the centre of the meadow Brook called thence, along the centre of the said brook the several course of the same down stream two hundred and forty road or until it intersects the south side line of lands of Alexander Grant, thence on the said line North Sixty five degrees West one hundred and forty five roads or until it comes to the first boundary and forty five roads or until it comes to the first boundary or place of beginning containing forty five acres be the same more or less.  With all and singular the houses out houses, ways, waters, water courses, building, improvements, privileges an appurtenances thereof or thereunto in any ways belonging or appertaining the reversion and reversions, remainder and reminders, rents, issues, and profits, thereof together with all the interest, right, title, claim, property and demand of him the said James Grant of in and to the within described lands and premises To have and to hold the same and every part and parcel thereof to him the said Donald Cameron his heirs and assigns forever and the said James Grant in and by these presents doth for himself his heirs and assigns covenant promise and agree to and with the said Donald Cameron his heirs and assigns in manner and form following that is to say that he the said James Grant is and now stands sized of a good and sufficient estate of inheritance in fate simple of in and to the said described lands and premises and that he will warrant maintain and defend the same and every part and parcel thereof against all and every claim or claims of any person or persons whatsoever claiming the same or any part thereof to him the said Donald Cameron his heirs and assigns forever.

In witness whereof the said James Grant and the said Elizabeth Grant hath to these presents their hands and seals subscribed and set the day and year first within written.

Signed, sealed and delivered in the presence of William McKenzie

 

Received on the day of the date of the foregoing indenture from the therein named Donald Cameron the sum of fifty pounds currency being in full the consideration money therein mentioned.

On the twenty second day of May in the year of our Lord one thousand eight hundred and forty eight Before me one of her majesty’s justices of the peace for the county of Pictou, Personally came and appeared Elizabeth Grant lawful spouse to the within named James Grant and who being by me examined separate and apart from her said Husband, acknowledged that she did sign and seal the within deed of indenture voluntarily and that she did thereby release and forever quit claim unto the lands within described into him the said Donald Cameron his heirs and assigns as Regards Dowers or otherwise.

I do certify that William McKay one of the subscribing witnesses to the foregoing deed came before me and made oath, that he witness to the same duly executed by James Grant and Elizabeth Grant the party’s thereto sworn to at the West Branch this 22nd day of May 1848
