Description Deed Donald Fraser & Wife to Alexander McKenzie

This indenture made this eight day of July in this year of our Lord one thousand eight hundred and thirty three, Between Donald Fraser of the west River of Pictou in the district of Pictou County of Halifax and Province of Nova Scotia, farmer and Nancy wife of the said Donald Fraser of the one part, and Alexander McKenzie of the upper settlement of said River district and county aforesaid, farmer of the other part. Witness that the said Donald Fraser and Nancy his wife for and in consideration of the sum of thirty six pounds of lawful money of Nova Scotia to them in hand well and truly paid by the said Alexander McKenzie at or before the ensealing and delivery of these presents, the receipt of which is hereby acknowledged Hath granted bargained sold, enfeoffed released and confirmed and by these presents Doth grant bargain, sell, release, enfeoff and confirm unto the said Alexander McKenzie his heirs and assigns forever all that certain piece lot or parcel of land, situate lying and being one the south side of the west River aforesaid, in rear of the River lot, being a part of lot number form on the original grant abutted and abounded as follows. Beginning at the south eastern angle of Donald McKenzie Land and being a part of the same lot from thence to run south forty five degrees West thirty three chains and sixty links to lands owned by the said Alexander McKenzie thence North forty five degrees West along said Lands forty five chains to lands owned by one Alexander Sutherland thence north forty five degrees east on said A. Sutherland and A. McKenzie lands thirty three chains and sixty links more or less to Donald McKenzie’s lands thence south forty five degrees East forty five chains to the place of beginning Containing one hundred and fifty acres more or less, together with all and singular the house, out houses barns, stables, building ways, water courses easements commodities privileges and appurtenances to the same belonging or in anywise appertaining and reversion and reversions, remainder and reminders, rents, issues, and profits thereof and also all the right, title, estate, claim, property, and demand of them the said Donald Fraser and Nancy his wife which they now have or hereafter may have to in or upon the same.

To have and to hold the said lot piece or parcel of land and premises with appetences unto the said Alexander McKenzie his heirs and assigns to his and their own proper benefit and behoof forever and the said Donald Fraser and Nancy his wife for themselves their Heir executors and assigns do by these presents grant covenant promise and agree to and with the said Alexander McKenzie his heirs executors administrators and assigns in manner and form following that is to say that they the said Daniel Fraser and Nancy his wife stands signed of a good sure indefeasible estate of inheritance in for simple of and in the lands and premises herein before granted and conveyed or intended so to be and every part thereof with the appurtenances thereof and that the said Donald Fraser and Nancy his wife have good right full power and lawful and absolute authority to grant sell and convey the said land and every part thereof unto the said Alexander McKenzie his heirs and assigns in manner and form as the same and hereinbefore granted or intended to be and that they the said Donald Fraser and Nancy wife their heirs and assigns all and singular the lot of land and premises above bargained and sold with the appurtenances unto the said Alexander McKenzie his heirs and assigns against the lawful claims and demands of all and every person or persons whatever shall and will warrant and Forever defend by these presents. In witness whereof the parties to these presents have hereunto there hands and seals subscribed and set the day and year first written above.

Received on the day of the date of the foregoing indenture from the within named Alexander McKenzie the sum of thirty-six pounds Nova Scotia Currency, being the full consideration money therein mentioned

On this twenth day of April in the year of our Lord one thousand eight hundred and thiry five, before me the subscriber one of his majesty’s justices of the peace for the county of Halifax Personally came and appeared Nancy Fraser the wife of Donald Fraser named in the foregoing Indenture and being by me examined separate and apart from her said husband declared and acknowledged that she freely and voluntarily and without force or compulsion from her said Husband singed, sealed and executed the said Indenture as and for her act and deed for the purpose therein mentioned.
