Description Deed Simon Fraser to Hugh McDonald

This indenture made this Eleventh day of December in the year of our Lord one thousand eight hundred and fifty one Between Simon Fraser if Chance Harbour, in the County of Pictou and Mary Fraser his wife of the one part and Hugh McDonald of the same place pilot of the other part,

Witnesseth, that the said Simon Fraser and Mary his wife for and in consideration of the sum of twenty pounds of lawful money of the province of Nova Scotia, to them in hand well and truly paid by the said Hugh McDonald, at or before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, Have and each of them Hath granted, bargained, sold, aliened, enfeoffed, released and confirmed and by these presents Do and each of them Doth grant, bargain, sell, alien, enfeoff, release and confirm unto the said Hugh McDonald his heirs and assigns All that piece or parcel of land, situate, lying and being at Chance Harbour in the County of Pictou described as follows that is to say that number eighteen of the grant of lands to the folders of the eighty second segment, commonly called the eighty second grant, formerly purchased from one Hugh McCarthy a soldier in that regiment by one John MacCabe the original grantee thereof being the said Hugh McCarthy containing one hundred acres more or less. Together with all and singular the houses, outhouses, lands, stables, builders, ways, waters, watercourses, easements, profits, commodities, privileges, and appurtenances to the same belonging or in any wise appertaining and the reversion and reversions remainder and remainders, rents, issues, and profits thereof and also all the estate, right, title, interest, property claim, and demand of him the said Simon Fraser, which he now hath or hereafter may have to, in or upon the same.

To have and to hold the said western majesty or half part as aforesaid unto him the said Hugh McDonald his heirs and assigns forever, to his and their only proper use, benefit and behoof forever. And the said Simon Fraser by these presents Doth grant, covenant, promise and agree, to an with the said Hugh McDonald, his heirs and assigns, in manner and form following that is to say, that he the said Simon Fraser, now stand purpose of a good and sufficient estate of inheritance, in an to the lot of land and premises before described and hath good right full premises before described and hath good right full power and lawful authority to grant, sell and convent the same in manner and form, as the same is herein and hereby granted and conveyed and that he the same with the appertainces unto the said Hugh McDonald and his heirs and assigns against the lawful claim and demands of him and every person and persons whomsoever with warrant maintain and forever defend by these presents. In witness whereof the parties to these presents, have hereunto their hands and seals subscribed and set the day and year first above and before written.

Signed, sealed and delivered in the presence of Donald Cameron and Duncan Fraser

Received on the day of the date of the foregoing indenture from the therein named Hugh McDonald, the sum of twenty pounds, being the consideration therein mentioned to be paid by him to me.

On this ___ day of December in the year of our Lord, one thousand eight hundred and forty one, before me the subscriber me f the majesty’s justices for the County of Pictou, personally came and appeared Mary Fraser wife of Simon Fraser, named in the foregoing Indenture, who being by me examined separate and apart from her said husband, declared and acknowledged that she freely and voluntarily and without force or compulsion from the said husband, executed the same for the purposes  therein mentioned.
