This indenture made this thirtieth day of September in the year of our Lord one thousand eight hundred and forty one, between William Kirk of St. Marys in the County of Guysborou and Province of Nova Scotia Farmer of the one part and Anthony McCool of the Green Hill of Pictou in the County of Pictou and Province of aforesaid Farmer of the other part witnesseth that the said William Kirk for and in consideration of the sum of forty pounds of lawful money of the province aforesaid by the said Anthony McCool to him in hand well and truly paid at or before the ensealing and delivery of these presents the receipt whereof his hereby acknowledged, Hath granted bargained sold aliened released and confirmed and by these presents doth grant bargain sell aliene release and confirm unto the said Anthony McCool his heirs and assigns all that certain tract of land situate lying an being at the Green Hill of Pictou aforesaid and described as follows, that is to say, on the south by land of Messers James and David Patterson, on the west by lands owned by Andrew Marshall, on the north by lands owned by Edward Brydon, on the east by lands granted to the late Governor Patterson, containing seventy six acres more or less with all and singular the houses outhouses buildings ways water water courses easement commodities privileges hereditaments and appurtenances to the same belonging or in any wise appurtaining and the revision and reversions remainder and remainders rents issues and profits thereof and also all the estate right title interest claim property challange and demand eithero at low or in equity of him the said William Kirk which he now hath or at any time hereafter can or may have of in to or out of the same and every part thereof to have and to hold the said tract of land and premises hereby granted and conveyed or mentioned or intended so to be with tho appurtenances unto the said Anthony McCool his heirs and assigns to his and his only proper use and behoof forever and the William Kirk for himself his heirs executors and administrators doth hereby grant covenant promise and agree to and with the said Anthony McCool his heirs executors administrators and assigns in manner and form following that is to say that he the said William Kirk is and now stand seized of a good sure perfect and indefeaseable estate of inheritance in fee simple of and in the lands and premises herein before described and that he hath good right full power and lawfull authority to grant sell and convey the same in mannor and form as the are herein and hereby granted sold and conveyed or intended so to be and it shall and may be lawful for the said Anthony McCool his heirs executors and administrators and assigns at any and all time here after peaceably and quitely to enter into have hold occupy possess and enjoy the said lands and premises and every part part thereof withi the appurtenances in witness whereof the parties to these presents have hereunto then hands and seals subscribed and set on the day and year first above written

Pictou - } I do certify that Duncan Falconer of the West Branch East River yoeman and whose name is subscribed to within this deed of Indenture as a witness came before me this day and being duly sworn maketh oath and saith that he was present at and witnessed the execution of the same by William Kirk the party there
