Description Thomas Lowden to William Foster

This indenture made at Pictou this twenty fourth day of November in the year of our Lord, One thousand, eight hundred and thirty six, Between Thomas Lowden and his wife Rachel Lowden of said Pictou of the one part, and William Foster of said Pictou on the other part, Witnesseth that the said Thomas Lowden for and in consideration of the sum of Sixty pounds, current money of Nova Scotia, to him in hand paid by the said William Foster, the receipt whereof is hereby acknowledged, Hath granted, bargained, sold, enfeoffed, released and confirmed by these presents, Doth grant bargain, sell, enfeoff, release and confirm, unto the said William Foster, his heirs, administrators, and assigns for ever, or certain tract of land situate, lying and being in said Pictou and in what is commonly called Fishers Grant, being the rear part of a lot of land, formerly owned by Francis Carmichael and bounded on the front or North by lands owned and occupied by Duncan Grant, on the east by lands owned and occupied by John Fraser and John Fulton, on the rear South, by lands owned by Henry Halton, and on the West, by lands owned and occupied by Donald McKenzie, containing one hundred acres more or less with all and singular, the houses, barns, buildings, ways, water, appurtenances and privileges, thereunto belonging with all rights and profits and the right title claim and demand of the said Thomas Lowden and of his wife Rachel Lowden, which they now have or may have to the before mentioned premises or any part thereof.

To have and to hold the before described grant of land sold granted and forever made over to him the said William Foster, His heirs, Executors, Administrators, and assigns, to his or their property and only benefit and behoof and also he the said Thomas Lowden, the said lot of land and premises and every part thereof, against the lawful claims of all and every person or persons, shall and will warrant and defend, by these presents-

Signed, sealed, and delivered in presence of David Crichton and John McKinney

Received, Pictou the twenty fourth day of November 1836, from William Foster, sixty pounds current money of Nova Scotia, being the full consideration money mentioned in the foregoing Deed.

Personally appeared before me, one of his Majesty’s justices of the peace for the County of Pictou Rachel Lowden wife of the before mentioned Thomas Lowden, who being by me examined apart from her said Husband, Declared that she voluntarily, and without compulsion, signed the foregoing Deed, and there by relinquished her right of Power to the Premises
