This Indenture made at Pictou this fourth day of April in the year of our Lord One thousand eight hundred and thirty four Between Hector M'Kenzie of Caraboo Island District of Pictou County of Halifax and Province of Nova Scotia and Elizabeth his wife of the one part, And Charles M'Kenzie of the Town of Pictou County and Province Aforesaid Innkeeper and Son to the Said Hector of the other Part Witnessesth that the said Hector MacKenzie and Elizabeth McKenzie his wife for and in consideration of the Sum of Fifty pounds Currency to them in hand paid by the said Charles MacKenzie at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged, Have granted, bargained, Sold, enfeoffed, released and confirmed and by these presents Do grant, bargain, sell, enfeoff, release and confirm unto the said Charles M'Kenzie his heirs and assigns All these certain Lots pieces or parcel of land situate lying and being in Caraboo Island aforesaid And is abutted and bounded as follows viz — Beginning on the East Side line of a lot of land formerly belonging to a certain Duncan M'Kenzie now the property of the said Charles MacKenzie at the mouth of a Brook from thence to run North fourty three chains fifty links or to the Gulf Shore Thence East ten chains at a right angle following the different courses of the shore to the West Side line of James Harris land thence South along said Harris's land fourty chains more or less to the head of the aforesaid Brook thence Westerly the different courses of the Brook to the place of beginning containing fourty acres more or less. Also another lot being the rear of the lot that the said Hector McKenzie is at present settled on, Beginning on the Gulf Shore at teh North East corner of said Lot from thence to run South fifty eight chains, thence west twenty chains to the east side line of the aforesaid James Harris Thence North Sixty Chains more or less to the Gulf Shore thence easterly the different courses of the shore to the place of beginning containing Sixty Acres And in both the aforesaid two tracts pieces or parcel of land, one hundred acres more or less with all and singular the Houses, out houses, stables, buildings, ways water water courses, easements, commodities and appurtenance to the same belonging or in anywise appertaining and the reversion and reversions, remainder and remainders, rents issues and profits thereof, and also all the right, title estate, claim property and demand of them the said Hector M'Kenzie and Elizabeth McKenzie his wife, which, they now have or hereafter may have to in or upon the same or any part thereof, To Have and To Hold the said lots and parcles of land and premises with the appurtenances unto the said Charles McKenzie his heirs and assigns to his and their own proper use benefit and behoof forever, And the said Hector McKenzie for himself his heirs, executors, and administrators doth by these presents grant convenant promise and agree to and with the said Charles M'Kenzie his heirs executors Administrators and Assigns in manner and form following, that is to say, that he the said Hector M'Kenzie and his heirs the said lots of land and premises above described and hereby granted and conveyed or intended so to be and every part and parcel thereof to the said Charles M'Kenzie and his heirs and assigns against the lawful claims and demands of all and every person or person whomsoever will warrant and forever defend by these presents,

On the Second day of February in the year of our Lord One thousand eight hundred and thirty befre me the Subscriber one of His Majesty Justices of the Peace for the County of Halifax personally came and appeared Elizabeth McKenzie wife of Hector M'Kenzie named in the foregoing Indenture and being by me examined separate and apart from her said husband declared and acknowledged that she freely and voluntarily and without any force or compulsion from her said husband, signed, sealed and executed and delivered the said Indenture as for her act and deed for the purposes therein mentioned.
