This Indenture Made this second Day of September In The Year Of Our Lord One Thousand Eight Hundred and Thirty six Between Evander McKenzie and Donald McKenzie of Caraboo in the District of Pictou, and Province of Nova Scotia, Yeomen, of the one part and William George Cochrane, late of Halifax in the said Province, Esquire, of the other part, Witnesseth that the said Evander McKenzie and Donald McKenzie for and in consideration for the Sum of Thirty six pounds to them by the said William George Cochrane, in hand well and truly paid at or before the Sealing and Delivery of these Presents, the Receipt whereof is hereby acknowledged, Have and each of them Hath Granted, Bargained, Sold, Aliened, Released and Confirm unto the said William George Cochrane, his Heirs and Assigns All the Land and Premises hereinafter described being Part of certain large tracts of Land, situate on the Harbour of Pictou, in the said Province, commonly known by the Name of Cochran's Lands, and whereof Wiliam Cochran deceased, was possesssed, and to which he claimed Title in his lifetime and at his death, and of which he caused Surveys and Allotments for Settlement to be made by Robert Patterson in the Year 1803, and by Alexander Miller and David McLean in the Years 1809 and 1810, and which Land and Premises hereby intended to be Conveyed , are more particularly described as All That certain Lot of parcel of land situate lying and being at Carribo in the District aforesaid being lot number sixty one in Block or Division Letter A in the said survey or allotment of the said Alexander Miller and David McLean and abutted and bounded as follows that is to say Beginning on the south shore of the Pictou Harbour at Pine Stump being the North East Corner of Lot number sixty two on Miller and McLeans plan thence South One hundred and thirty seven chains to a stake and stones on the General --- line of the front Division of Lots on said Harbour thence East Forty Rods thence North One Hundred and thirty chains to a marked Spruce tree, on the Harbour aforesaid thence North Westwardly by the several courses of the Harbour aforesaid to the place of beginning containing and one hundred and thirty five acres more or less — together with all and singular the Hereditaments and Appurtenances belonging or in any wise appertaining to the Land and Premises hereby intended to be Granted or Conveyed, and every part thereof, and the Reversion, and Reversions, Remainder and Remainders, Rents, Issues and Profits thereof, and also All the Estate, Right, Title, Interest, Property, Claim and Demand, whatsoever, either at Law or in Equity of the said Edward McKenzie and Donald McKenzie in to or out of the same, and every part thereof with the Appurtenances To Have and To Hold the said Land and Premises hereby Granted and Conveyed, or mentioned or intended so to be, and every part thereof with the Appurtenances, unto him the said William George Cochrane, his Heirs and Assigns, to his and their own proper use and behoof forever.
And the said Edward McKenzie and Donald McKenzie their Heirs, Executors and Administrators doth by these Presents, Grant, Covenant, Promise and Agree to and with the said William George Cochrane, his Heirs and Assigns, in manner following, that is to say, that they the said Edward McKenzie and Donald McKenzie, shall and will truly pay or cause to be paid to the said William George Cochrane, his Executors, Administrators or Assigns, the full Sum of Thirty Six Pounds of Lawful Money of Nova Scotia in three Years, but equal Annual Installments with Interest Annually, as the rate of Six per Centum per Annum upon the Principal date, that is to say, on the second Dady of September in each and every Year from henceforth, until the whole Principal and Interest shall be fully paid: —
And also that the said Edward McKenzie and Donald McKenzie has not at any time heretofore, done or suffered, and will not do or suffer any Act, Deed, Matter or Thing whatever, whereby the said Land and Premises hereby intended or Conveyed, or any part thereof, is or are, or can or may be charged, incumbered, or in any manner affected in Title, Charge, Estate, or otherwise howsoever, And also that he the said William George Cochrane, his Heirs and Assigns, shall and may at all times hereafter, Have, Hold, Occupy, Possess and Enjoy all and singular the said Land and Premises hereby intended to be Conveyed with the Appurtenances, without the let, suit, molestation, interruption, eviction, or disturbance of the said Edward McKenzie and Donald McKenzie their Heirs or Assigns, or any other Person or Persons, claiming or to claim by from or under them any or either of them.
Provided Always nevertheless, and it is the true intent and meaning of these Presents, that if the said Edward McKenzie, and Donald McKenzie their Heirs, Executors, Administrators, or Assigns do and shall will and truly pay or cause to be paid to the said William George Cochrane, his Executors, Administrators, or Assigns the said full Principal Sum of Thirty Six pounds of Lawful Money of Nova Scotia in Three Years, by equal Annual Installments with Interest Annually at the Rate aforesaid upon the Principal from time to time remaining due, that is to say, on the second Day of September on each and every Year henceforth, until the whole Principal and Interest shall be fully paid in manner and form as the same are secured to be paid to the said William George Cochrane, by the certain Bond or Obligation of the said Edward McKenzie and Donald McKenzie being even Date herewith, then these Presents, and every Matter, Clause and Thing therein contained shall cease and become utterly null and void.
In Witness whereof the Parties to these Presents have hereto interchangeably set their Hands and Seals, the Day and Year first above written.
