Description Crowel Hutch & wife to James McDaniel

This indenture made the tenth of November in the year of our Lord one thousand eight hundred and fifty four, Between Crowel Hutch of the Middle River Pictou farmer and Agnes Hatch his wife of the one part and James R. McDaniel of the said place of the other part couch maker Witnesseth that for the sum of tree pounds Halifax currency to them in hand paid the Receipt where of is hereby acknowledged have and each of them hath Granted Bargained, sold, Alienated, enfeoffed, released, and conformed, all that lot of land being on the west side of the foresaid middle River, and bounded as follows. Beginning at the south corner of said Crowel Hatches land on the berge of the stream of the Smith Brook so called, thence North seventy degrees west, five roads to the bank if the high land thence North-easterly on the said lands as well admit of building a Dam or Break water, on the said Smiths brook twenty feet in perpendicular light, at a distance of thirteen roads from the bridge now on the said brook, without interfering with flow of the water of said Dam, until said line intersects the line of land bought by said James R. McDaniel, thence South seventy degrees east five roads or to the stream of said brook, thence upstream the several courses of the stream twenty six roads more or less to the place of beginning, containing therefore of an acre, more or less also the privilege of a suitable road fifteen feet broad o though land Crowel Hatch’s lot near the said bank or pond tree, to said James R McDaniel line as aforesaid, to have and to hold the said lot or parcel of land to him the said James R. McDaniel and line as aforesaid , To have and To hold the said lot or parcel of land to him said  James R. McDaniel and to his heirs Executors and assigns for their sole use benefit and behoof, forever, with all the right title claim and demand of them the said Crowel Hath with all and singular the appurtenances resigning at all times to the ways waters, rents and issues thereof. In witnesses whereof the water of said pond of the thereafter for the benefit of said parties have hereunto their hands and seals subscribed and set day and date first within witness.

Not the above was investment by consent of parties before the foregoing deed was executed

Received day and date as above from the above named James R. McDaniel the sum of three pounds currency being in full the purchase money for the within described premises

Personally appeared before me one of her majesty’s justices of the peace for the County of Pictou Mrs. Agnes Hatch the lawful spouse of above named and signed Crowel Hatch and who is a party to the foregoing and written deed and being by me examined separate and apart from her said husband did declare that the signed and sealed the foregoing Deed of her own face will and accord without any force or compulsion on the part of her said husband to cause her to do thereby giving for all her night and witnessed to the said premises to the forward James MacDonald his Heirs and assigns both at law and in equity.

Given under my hand at Middle River November 11 1854 Alex Fraser personally came before me James Halliday one of the subscribing witnesses to the foregoing Deed who made oath that he was present and save the said Deed duly executed by Crowel Hatch and Agnes Hatch the parties thereto
