This indenture, made the ____ day of September, in the year of our Lord one thousand nine hundred and six, Between J.SIM HARRIS, of Pictou, in the County of Pictou, High Sheriff for the County of Pictou, of the one Part; and J. FRANKLIN SHATFORD, of Halifax, in the County of Halifax, Merchant, of the other part.
WHEREAS, in a certain suit lately commenced and prosecuted in the supreme Court of Judicature for the Province of Nova Scotia between J. Franklin Shatford as plaintiff and Charles McKinnon, defendant, the said plaintiff sought the fore-closure of all the right and equity of redemption of the defendant and all persons claiming or entitled by, through or under him in and to the lands and premises herein after described and a sale of the said real estate towards payment of a large sum of money due the plaintiff by virtue of a certain Indenture of Mortgage made by the said defendant as Mortgagor to said plaintiff as Mortgagee and dated the 10th day of August, A.D. 1899, and the said plaintiff’s case having been fully proved and established to the satisfaction of the Court, according to the rules and practices thereof, the said Court did among other things other and decree that the equity of redemption of the defendant in the premises described in said mortgage sought to be foreclosed in said suit and all those claiming by, from or under him be forever barred and foreclosed, and that the sale of the said lands and premises should be advertised in the “eastern chronicle” newspaper published in New Glasgow, for at least thirty days before the day appointed for such sale by one insertion each week during that time and by handbills posted in the said County of Pictou for at least ten days before the day appointed for such sale and that said premises should be sold at Public Auction by the Sheriff of the County of Pictou to the highest and best bidder and that upon payment of the purchase money, the sheriff should made a good and sufficient deed to the purchaser there of.
AND WHEREAS, the said mortgaged premises were, on the twenty-first day of September, A.D., 1906 by virtue of said order or decree and in conformity with the directions and in pursuance of the notice previously given in the manner and for the time specified, set up for sale at Public Auction by and before the said J.Sim Harris, the said sheriff of the County of Pictou aforesaid, and after being by him exposed for sale for the usual time were knocked down and sold by the said J. Sim Harris to J. Franklin Shatford, the party of the Second part aforesaid, for the sum of ____ dollars, he being the highest and best bidder therefor.
Now this indenture witnesseth, that the said J. Sim Harris, as such Sheriff and in pursuance of said order and decree and in consideration of the premises and of the sum of ___ dollars, of lawful money of Canada, to him the said J. Sim Harris in hand well and truly paid by the said J. Sim Harris in hand well and truly paid by the said J. Franklin Shatford for the uses and purposes in said order and decree mentioned, at or before the sealing or delivery of these presents, the receipt whereof is hereby acknowledged, Hath granted, bargained, sold, aliened, enfeoffed, released, remised, conveyed and confirmed; and by these presents Doth grant, bargain, sell, alien, enfeoff, release, remise, convey and confirm, unto the said J. Franklin Shatford, his Heirs and Assigns, ALL that lot, piece, and parcel of land situate, lying and being in New Glasgow, County of Pictou, aforesaid, bounded and described as follows, that is to say:
Beginning at the Northwest angle of a field now or lately occupied by the said Charles McKinnon on the East bounds of a street called High Street and on the North bounds of a Street called High Street and on the North bounds of a Street running south fifty-seven degrees East and from thence North thirty-six degrees East three chains and ninety-nine links; thence south thirty-six degrees west three chains and ninety- nine links to the North bounds of a street running south fifty-seven degrees East; thence North fifty-seven degrees West two chains and twenty link to the place of beginning containing a hundred and forty square roods be the same more or less within the above described bounds. All the above bearings are by the magnet A.D. 1854, and the buildings, hereditaments, easements and appurtenances to the same belonging, and the reversions, remainders, rents and profits thereof, unto and to the use of the said J. Franklin Shatford, his Heirs and Assigns forever.
In witnesseth whereof, the said party to these presents has hereunto set his hand and affixed his seal the day and year first above written.
