Description James Ferguson and wife to John Murray

This indenture, made this sixth day of September in the year our Lord one thousand eight hundred and ninety-nine Between James Ferguson, of Vancouver in the Province of British Columbia, (carpenter); and Elizabeth his wife of the one part, and John Murray of Pictou in the County of Pictou, and Province of Nova Scotia, of the other part WITNESETH, that the said James Ferguson and Elizabeth Ferguson his wife, for an in consideration of nineteen hundred dollars of lawful money of Canada to the said James Ferguson and Elizabeth Ferguson his wife in hand well and truly paid by the said John Murray at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released, remised, conveyed and confirmed and by these presents do grant, bargain, sell, release, remise, convey and confirm, unto the said John Murray and his Heirs and Assigns, ALL that lot, piece, or parcel of land, situate, lying and being at Pictou in the County of Pictou aforesaid and bounded and abutted as follows; Viz. Beginning at an iron pin at a point on the south side of Cottage street, thence running South parallel to said Martha Street, thence running South parallel to said Martha Street on hundred and twenty-eight feet to a board fence; thence west along said board fence  one hundred feet to the eastern boundary of aforesaid Martha Street; thence running North along the Eastern boundary of said Martha Street one hundred and twenty-eight feet to the South side of aforesaid Cottage street; thence East along said Cottage Street to the place of beginning, and the building hereditaments, easements, and appurtenances to the same belonging, and the reversions, remainders, rents, issues and profits thereof, and all the estate, right title, interest, claim and demand of the said James Ferguson and Elizabeth Ferguson his wife of, in, or to the same TO HAVE and TO HILD the said above granted and described land and premise, the appurtenances unto, and to the use of the said John Murray and his Heirs and Assigns forever.  And the said James Ferguson and Elizabeth Ferguson his wife, for themselves and their heirs, Executors and Administrators, do hereby covenant with the said John Murray and his Heirs and Assigns; That they the said James Ferguson and Elizabeth Ferguson his wife have a good, sure perfect, and indefeasible estate of inheritance in fee simple in the lands and premises and have also good right, full power, and absolute authority, to grant and convey the same, in manner and form aforesaid according to the true intent and meaning hereof.  AND also that the said John Murray and his Heirs and Assigns, shall and may at all times hereafter, , peaceably and quietly hold and enjoy the said lands and premises, with the appurtenances, without hindrance or disturbance of, from or by the said James Ferguson, and Elizabeth Ferguson his wife, or any person or persons whom soever lawfully claiming the same, or any part thereof.  And also that the said James Ferguson and Elizabeth Ferguson his wife, and their Heirs, the said lands and premises unto the said John Murray, his Heirs and Assigns against the lawful claims and demands of all persons shall and will by these presents WARRANT and forever defend.

I Benjamin Johnston a Notary Public duly authorized and admitted practicing at Vancouver in the Province of British Columbia, and Dominion of Canada do hereby certify that on this sixteenth day of September 1899 before me the subscriber, personally came and appeared Elizabeth Ferguson wife of James Ferguson mentioned in the foregoing indenture, who having been by me examined separate and apart from her said husband, did declare and acknowledge that she executed the said Indenture, as and for her act and deed, Without fear, threat, or compulsion, of, form or by her said husband, and for a full release of all her claims to the land therein described.
