This indenture made this 11th day of September, A.D., 1940,
BETWEEN:
Stewart R. Elliott of Trenton in the County of Pictou Province of Nova Scotia, and Isabel Elliott, his wife; Jennie Sinclair of Chance Harbour in the County and Province aforesaid, and Ernest Sinclair, her husband; Annie Fraser of New Glasgow in the County and Province aforesaid, and George Fraser, her husband; and John William Elliott of Telkwa in the Province of British Columbia, and Nina Elliott, his wife, also of said Telkwa, presently of New Glasgow aforesaid; beign all the heirs of the late James Elliott of Black Point in the County of Pictou, deceased, hereinafter called the “GRANTORS”
OF THE OTHER PART,
Howard Ross of the Town of New Glasgow in the County of Pictou, Province of Nova Scotia, Undertaker; hereinafter called the “GRANTEE”,
OF THE OTHER PART.
Witneseth that the said Grantors for and in consideration of the sum of One Hundred and Thirty five Dollars ($135.00) of lawful money of the Domain of Canada, to the said Grantors in hand well and truly paid by the said Grantee at or before the sealing and delivery of THESE PRESENTS, the receipt whereof is hereby acknowledged, have and each of them hath remised, released, and forever quitted claim, and by these presents do and each of them doth remise, release, and forever quit claim, unto the said Grantee, his heirs and Assigns , ALL that certain lot, piece or parcel of land situate, lying and being at Black Point in the District of Little Harbour, in the County of Pictou, Province of Nova Scotia, and more particularly bounded and described as follows:
BEGINNING at a point along the shore of the Northumberland Strait where the southern line of a lot of land now owned and occupied by one Mrs. W. G. Fulton intersects the northern boundary of the lands of the late James Elliott; thence running south-westerly along the division line of the lands of the said Mrs. Fulton a distance of Three Hundred (300) feet; thence south-easterly and in a line parallel to high-water mark along the shore a distance of sixty-two (62) feet; thence north-easterly and parallel to the first mentioned line along the dividing line of Mrs. Fulton’s lot, a distance of three hundred (300) feet or until it comes to high-water mark; thence along high water mark a distance of sixty-two (62) feet to the place of beginning,
Together with all and singular the Easements, Tenements, Hereditaments and Appurtenances to the same belonging, or in anywise appertaining with the reversion and reversions and remainder, rents, issues and profits thereof, and all the estate, right, title, interest, claim, property and demand, both at law and in Equity of the said Grantors of, in, to or out of the same, or any part thereof, unto and the use of the said Grantee, his Heirs and Assigns, to his and their sole use, benefit and behoof forever.

Elliott, mentioned in the foregoing Indenture, who having been by me examined separate and apart from her said husband, did declare and acknowledge that the said Indenture is her free act and deed and that she executed the same freely and voluntarily, without fear, threat or compulsion of, from or by her said husband, and for a full release of all her claims to lands therein mentioned.
