Description Lease Emilie Elliott to H.H. Magee

This indenture made in duplicate this eleventh day of April in the year our Lord one thousand and five. BETWEEN Emilie Elliott of Pictou in the County of Pictou, Widow, and C. Clifford. Elliott of Pictou in the County of Pictou, Widow, and C. Clifford. Elliot of Calgary in the North West Territories Engineer, hereinafter called the lessors of the first part, and Herbert Harriss Magee of Saint John in the Province of New Brunswick, Commercial Traveller, hereinafter called the lessee of the second part.

WITNESSETH that the said lessors for and in consideration of the rents, covenants and agreements hereinafter mentioned, reserved and contained and agreements herein after mentioned, reserved and contained, on the part and behalf of the lessee, to be paid, kept and preformed, have leased, demised and let, and by these presents do lease, demise and let unto the said lessee, All that certain house and premises situate on the North Side of Cottage Street in the town of Pictou in the County aforesaid (exclusive of the fields adjoining the same) TO HAVE and TO HOLD the said above mentioned and described premises, with the appurtenances, unto the said lessee, for and during the term of one year to be computed from the first day of May A.D. 1909, yielding and paying therefore, to the lessors yearly, and every year during the said term hereby granted, the yearly rent or sum of one hundred and forty dollars in equal monthly payments on the last day of each and every month, during the said term, of one year, the first payment to be made on the last day of May A.D. 1909. AND the said lessee doth hereby covenant and agree to pay to the said lessors the said rent as herein specified, and to pay electric light rates, and to pay all damage or breakages caused or permitted by the lessee by reason of want of such care as would be given by an owner of the said premises under like circumstances, and to repair, reasonable wear and tear and damage by the elements expected, and said lesser will not assign or sublet said demised premises without leave, and at the expiration of said term or other determination of this lease he will quit and surrender the premises hereby demised is as good state and condition as reasonable use and wear thereof will permit, damage by the elements excepted.

PROVIDED and it is expressly agreed between the parties hereto, that in case the lessors shall sell or agree to sell demand item premises during said term, the said term may be determined at any time upon three months notice, by a notice to such effect being delivered to any person upon the said premises, or mailed by posting the said notice at the post office at Pictou aforesaid in an envelop addressed to the lessee at Pictou aforesaid, and that the lessee will at the expiration of the time limited by the said notice peaceably and quietly give up possession of the said premises to the lessors. 

AND PROVIDED that if any rent shall be due and unpaid, or if default shall be made in any of the covenants herein contained, then it shall be lawful for the said lessors to re-enter the said premises, and to remove all persons therefrom. 

AND the said lessors covenant that the said lessee on paying the said rent as herein specified and performing the covenants aforesaid, shall and may peaceably and quietly have, hold and enjoy the said described premise as aforesaid.

IT is hereby declared and agreed that these presents and everything herein contained shall respectively ensure to the benefit of and be binding upon the parties hereto their heirs executors administrators and assigns respectively.
