Description Deed Margaret Carson to LW. & GA Carson

This indenture made this eighteenth day of December in the year of our Lord one thousand nine hundred and six.

Between Margaret Carson, Widow of James Carson late of Pictou in the County of Pictou, Lumber Dealer, deceased, intestate, James Edward Carson, Manager, and Susan J. Carson his wife, Bessie McLellan Married Woman, and Clinton McLellan her husband, Morna Carson, Single Woman, and Harry Carson, Merchant, all of Pictou in the County of Pictou, and Johnstone Carson of Montreal in the Province of Quebec, Commercial Traveller, and Lillian Carson his wife, heirs-at-law of said James Carson deceased, intestate, hereinafter called the parties of the first part of the one part, and John William Carson of Pictou, aforesaid, Lumber Dealer, and George Adam Carson of the same place Lumber Dealer, also heirs at law of said deceased, hereinafter called the parties of the second part of the other part. 

Witnesseth that the said parties of the first part in consideration of the sum of one dollar to them now paid by the said parties of the second part, the receipt whereof is hereby acknowledged, do and each of them doth hereby grant, release and quit claim, unto the said parties of the second part their and each of their heirs and assigns all the estate, right, title, interest, claim and demand whatsoever, both at law and in equity or otherwise howsoever, or whether in possession or expectancy of the said parties of the first or either of them, of, in, to or out of, All those certain lot pieces or parcels of land situate lying and being in the Town of Pictou in the County of Pictou bounded and described as follows:-

First. All that certain lot of piece or parcel of land and land covered by water situate lying and being in the Town of Pictou aforesaid bounded and described as follows- Beginning at the South west corner of a lot of land granted to said John William Carson by deed bearing even date herewith, thence running into the harbour south seventeen degrees west five hundred and thirty feet, thence south sixty one degrees east fifty seven feet, thence north seventeen degrees east parallel to the west line until it reaches the south east corner of the lands granted to said John William Carson as aforesaid, thence west along the south line of said last mentioned lands fifty seven feet more or less to the place of beginning. 

Second All that certain lot piece or parcel of land situate in said Town of Pictou, bounded and descried as follows- bounded on the north by lands of said John William Carson and the lands first above described, bounded on the south by lands owned by said Town of Pictou, and bounded on the west by the east side line of South Market Street. 

Third. All that other lot piece or parcel of land situate lying and being in the Town of Pictou aforesaid bounded and described as follows- Beginning on the west margin of the Public Landing between the property formerly owned by Mary and Hannah Meagher at a point distant one hundred and forty two feet six inches southwardly along said lane from the south margin of Water street, and running thence south twenty and one half degrees west along said lane thirty six feet six inches to a lot now or formerly owned by Mary Meagher, thence sixty three degrees west along the north line of said lot forty five feet six inches to the east line of lands formerly belonging to William Gordon deceased, thence North twenty three and one half degrees east along the last mentioned line thirty six feet eight inches to the southwest corner of a lot of land now or formerly owned by said Mary Meagher, thence south sixty three degrees east along the south line of the last mentioned lot forty seven feet six inches to the place of beginning , together with all and singular the factory warehouses, mills, mill gear, machinery, milling impliments, tools, and all stock   including building material and lumber of every kind and description in on, upon or about said above described lands and premises, together with the appurtenances thereto belonging or appertaining, TO HAVE and TO HOLD the same and every part thereof with all and singular the appurtenances thereto belonging or appertaining unto and to the use of the said parties of the second part their and each of their heirs and assigns forever.

Provided always nevertheless and these presents are upon the express conditions that the said parties of the second part their and each of their heirs executors, administrators, or assigns shall pay or cause to be paid all debts and claims for money due and owing by said James Carson, deceased, in and about the business carried on by him at the time of his death on the above described lands and premises: and further provided that the said parties of the second part shall pay or cause to be paid to the Town of Pictou yearly and every year for the term of ten years from the date hereof all taxes legally rated and levied on the following lands and premises:- (I). The lands premises conveyed to Margaret Carson by deed bearing even date herewith. (2) The lands and premises conveyed to said Morna Carson by deed bearing even date herewith. (3) The lands and premises conveyed to Margaret Ethel Carson by deed bearing even date herewith.  (4) The lands and premises conveyed to Lillian Agnes Carson by deed bearing even date herewith. (5) The lands and premises conveyed to Olivia Edwina Carson by deed bearing even date herewith.

Be it remembered, That on this 29th day of January 1907 before me, the subscriber personally came and appeared Susan J Carson wife of James Edward Carson mentioned in the foregoing indenture, who having been by me examined separate and apart from here said husband did declare and acknowledge that she executed the said indenture as and for her act and deed freely and voluntarily without fear threat or compulsion of, form or by her said Husband and for a full release of all her claims to the land therein mentioned

Be it remembered, That on this 29th day of January 1907 before me, the subscriber personally came and appeared Bessie McLellan wife of Clinton McLellan mentioned in the foregoing indenture, who having been by me examined separate and apart from here said husband did declare and acknowledge that she executed the said indenture as and for her act and deed freely and voluntarily without fear threat or compulsion of, form or by her said Husband and for a full release of all her claims to the land therein mentioned.

Be it remembered, That on this 8th day of February 1907 before me, the subscriber personally came and appeared John W. a subscribing witness to the foregoing indenture, who having been by me duly sworn made oath and said that Margaret Carson, James Edward Carson, Susan J. Carson, Bessie McLellan, Clinton McLellan, Morna Carson, Harry Carson, John William Carson and George Adam Carson the parties thereto signed sealed and delivered the same in his presence.

I, William _____ a Notary Public duly qualified commissioned and authorized residing and practising at the City of Montreal in the Province of Quebec, Canada do hereby certify that on this twenty-eight day Of December A.D. 1906, before me the subscriber personally came and appeared Lillian Carson wife of Johnstone Carson mentioned in the foregoing indenture, who having been by me examined separate and apart form her said husband did declare and acknowledge that she executed the aid indenture as for her act and deed freely and voluntarily without fear threat or compulsion of, from or by her said husband and for a full release of all her claims to the lands therein mentioned.
