Copy Assessment Alexander Cameron
This indenture made the twenty-first day of May. In the year our Lord one thousand nine hundred and eight in pursuance of the “Assignment Act” and Acts in amendment thereof, and every other law and statute applicable to assignments and conveyances of real and personal property.
Between Alexander Cameron of Hopewell in the County of Pictou, carriage maker, hereinafter called the “Debtor” of the first part and Charles W. Ives of Pictou in the County of Pictou, Official Assignee, hereinafter called the “Creditors” of the third part:
Whereas the “Debtor” has heretofore carried on business at Hopewell in the County of Pictou as a Carriagemaker and Farmer, and being unable to pay his creditors in full hath agreed to convey and assign to the “Assignee” all his estate of every nature and kind real and personal for the purpose of paying and satisfying the claims of his creditors rateably and proportionately, and without preference or priority.
Now this indenture witnesseth that in consideration of the premises and of the sum of one dollar the “Debtor” doth hereby grant and assign to the “Assignee” his heirs, executors, administrators and assigns all his personal property which may be seized and sold under execution and all his real estate, goods property, credits and effects.
To have and to hold the same unto the “Assignee” his heirs, executors, administrators and assigns respectively according to the tenure of the same upon trust that the “Assignee” his heirs, executors, administrators and assigns shall sell and convey all the said real and personal estate and goods and property and effects and convert the same into money and collect and call in all debts, dues, demands and credits of the “Debtor.”
And it is hereby declared that the “Assignee” his heirs, executors, administrators and assigns stand possessed of the money derived from the sale of the real and personal estate goods and property and effects and the moneys collected and called in and other moneys which the “Assignee” his heirs, executors, administrators and assigns shall or receive from or on account of the premises hereinbefore assigned upon trust in the first place, to pay the cost of and incidental to the execution of these presents: secondly to deduct and retain such remuneration as shall be voted or fixed for the “Assignee” under the provisions of the “Assignments Act” or Acts in Amendment thereof; and thirdly to pay the debts and liabilities of the “Debts” in full to hand over to the “Debtor”.
The “Debtor” appoints the “Assignee” his lawful attorney irrevocably name to do all matter and things, make, sign, seal, and execute all deeds, docunments and papers necessary to more fully perfect in him the title to the lands, premises, real and personal estate, goods and chattels, debts, dues, demands, credits and effects, hereby assigned or intended so be; and to do all other matter and things necessary to enable the “Assignee” to carry into effect these presents.
And it is hereby declared that if it shall be in the interest of the creditors so to do the “Assignee” may sell the book debts or any portion thereof either by public auction or private contract.
