Notice is hereby given to the Defendant that if he do not appear and plead within four days after the period specified in this writ for his appearance, the Plaintiffs shall be at liberty to sign final judgement for any sum not exceeding the sum claimed in their particulars of demand with interest at the rate specified, and costs, at the expiration of such time.

            Notice of trial is also hereby given in this cause for the first day of the term of the said Court next after the defendant shall appear and plead herein.

“PICTOU, S.S. VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, and of the United Church of England, and Ireland, on Earth the Supreme Head.

To the Sheriff of Pictou                                  or to any of our Sheriffs:

We command you to summon Ebenezer McLeod of the West River in the County of Pictou, yeoman

to appear in the Supreme Court at Pictou, within ten days after the service of this writ, at the suit of James Primrose, James Ross, and John T. Ives Executors of the last Will and Testament of William Matheson deceased who say that the said Ebenezer McLeod is indebted to them for that the defendant on the twenty seventh day of May in the year of our Lord One thousand eight hundred and fifty nine in the life terms of the said William Matheson by his promissory note now over due Six months after date for  value received promised to pay to the said William Matheson or order the sum of Twenty five pounds eighteen shillings and three pence Nova Scotia currency with interest until paid. Yet the defendant hath not paid the [sum] to the said William Matheson in his life time nor to the Plaintiffs since his death.

And they claim Two hundred dollars

Part of the MacLeod Papers Collection containing the files of Ebenezer McLeod of West River, a Hector descendant and surveyor, and his son Daniel. The papers, which are from the 19th and 20th centuries, were saved by Ebenezer’s great-great-grandson Medford MacLeod, also of West River, NS.
