Certified Copy of Will for Reg of Deeds Pictou

I Catherine Rogers of Pictou in the County of Pictou, Widow do make publish and declare this my Last Will and Testament hereby revoking all former wills by me at any time heretofore made.

I give devise and bequeath to my daughter Annie James Rogers to Cabinet organ in my dwelling in so far as I have any right to dispose of the same.

If at any time here after any money dividends stock or other returns shall be returned or realized from the shares in the B&D Mountain Me** and Dep**ment Company acquired by me from the estate of the late John Creighton my brother I will and direct that the same shall be equally divided between my children me surviving.

I give and bequeath to my daughters me surviving equally to be divided between them all my monies mortgages household Furniture and personal property of whatsoever nature and kind and wheresoever situate.

I give devise and bequeath to my son James Anthony Rogers my dwelling messuages and premises situate on the east side of Elliott Street in the town of Pictou with the fixtures and fittings thereto belonging or appertaining to hold the same in and upon the following terms trusts and Conditions viz, in trust their to provide a home for his sisters or such of them as shall remain single and upon the marriages of his sisters or the death of such of them as shall remain single to hold the same absolutely to his own use, in case of the death of the said James Anthony Rogers before his sisters who may then be entitled to have a home then provided for them as hereinbefore mentioned then in such case then said Dwelling messuages and premises shall immediately revert to my daughters then living and their entitled to a home.

Provided nevertheless that if the said James Anthony Rogers be unwilling to accept to undertake or carry out the foregoing trust terms and conditions or should his sisters or any two of them or the survivor of them reaming single be dissatisfied with the home provided worthiness in continuing to that effect the said James Anthony Rogers may thereupon pay to his sisters or the survivors of them the sum of five hundred Dollars and shall thereupon and thereafter hold the said Dwelling messuage and premises absolutely to his own use from and discharged from all claims of his sisters, should he neglect or refuse to make such payment when notified as aforesaid my executors hereinafter named or any two of them shall or the survivor of them shall sell at Public auction or by private sale the said messuages and premises and dwelling and shall out of the proceeds of such sale pay in the first balance the expenses of such sale, in the second place the sum of Five hundred Dollars to my daughters their survivors and the balance then remaining shall pay to my son James Anthony Rogers.

I hereby nominate constitute and appoint my said daughter Annie James Rogers my son James Anthony and John H. Ross Barrister to be the executors and Trustees of this my Will.

In witness whereof I have hereunto my hand subscribed and set this ninth day of December AD 1904.

McLeod Registrar of said Court do hereby certify that the foregoing paper writing is a true copy of the last Will and Testament of Catherine Rogers late of Pictou in the County of Pictou Widow deceased which said will was duly admitted to Probate in said Court at Pictou on the 19th. day of July AD 1905.
