Copy of Will for the Registrar of Deeds
In the name of God, Amen the twentieth day of February in the year of our Lord One Thousand Eight Hundred and Seventy nine, I, Hugh Sutherland of Mill Brook, Middle River, in the County of Pictou, being of perfect mind and memory, thanks be unto God therefore calling into mind the mortality of the body, knowing that it is appointed for all men once to die do hereby make and ordain this my last Will and Testament, that is to say principally and first of all I give and recommend my Soul unto God who gave it, and my Body I recommend to the earth to be buried in a decent Christina burial at the discretion of my family and Executors nothing doubting but at the general resurrection I shall receive the same again by the Almighty Power of God, and as touching such worldly Estate wherewith it hath pleased God to bless me with in this life I give devise and dispose of the same in the following manner that is to say
First I give and bequeath to Robert Sutherland my beloved son all my lands Tenements and stock consisting of Horses Cattle and Sheep together with all the framing implements subject to the following conditions and considerations, that my daughter Anne Sutherland Jane Sutherland and Christy Sutherland shall have a home on and their living of the place to include their clothing in the same manner and may as they had with me and him during my life time, also that my said son Robert Sutherland will and shall pay to y said daughters the sum of Forty Dollars Currency each - said sum to be paid in installments of Eight Dollars to each a year until the whole is paid. In the event of any or all of my said daughters leaving he place and home by marriage then their living and clothing as above stated shall cease and the Cash bequest to be paid in full on the occasion of one or all of their leaving the place for marriage.
I hereby ordain that my said son Robert Sutherland shall occupy enjoy and possess all the property I own and assess as hereinbefore stated peaceably without let or encumbrances whatsoever from any person or persons lawfully claiming the same subject to the conditions above specified.
And I do hereby utterly disallow revoke disannul all and every other former Will or Testament legacies bequests and Executors by me in any wise before named willed and bequeathed ratifying and confirming this and no other to be my Last Will and Testament.
I hereby nominate and appoint Mr. John Sutherland of Mill Brook and my said son Robert Sutherland as joint Executors of this my last Will and Testament.

This twentieth day of February in the year of our Lord One Thousand Eight Hundred and Seventy nine I Hugh Sutherland deem right and proper to add this Codicil to my Will above signed by me that is to say that
My daughter Anne Sutherland shall have and own for their benefit for so long as they remain unmarried the one half of the sheep as will be raised and fed with from this day bequeathed to my son Robert Sutherland and I ordain that the Codicil shall have the same force and meaning as the Will herein left bequeathed by me.

I do hereby certify that the Instrument on the three preceding folios of are an exact and literal copy of the last Will and Testament of Hugh Sutherland late of Mill Brook, in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
Given under my hand at Pictou this 7th. day of July A.D. 1879.
