Estate of William Smith late of Ponds, Esquire deceased, Testate
Copy of Will for the Registrar of Deeds
Know all men by these presents that I, William Smith of Lower Barney's River, in the County of Pictou, Province of Nova Scotia and Dominion of Canada, Esquire, being sound disposing mind and memory do hereby make and publish this my last Will and Testament.
I give devise and bequeath to m y nephew Charles Smith the one undivided half of all that Lot of land at Ponds in said County of Pictou and whereon William Fisher and I the said William Smith Esq. now resides, the one half containing Sixty two acres more or less, and Bounded as follows, on the North by the Strait of Northumberland, on the East by land of John and William Patton, on the South by the rear line of the Eighty Second Grant, on the west by Hugh McDonald's land to Have and to Hold the said premises with the appurtenances to him, the said Charles Smith to him and his heirs and assigns forever., without any conditions whatsoever, except that the said Charles Smith is to stay on the said Farm with the said William Smith and William Fisher, to assist them to work said farm to the best advantage for them and himself.
I also give devise and bequeath to the said Charles Smith the undivided half of all the stock on said farm, Farming implements, which I own or may own at my decease, also what Household furniture I own, also the one half of the House which I own, To Have and to hold the same to him the said Charles Smith to his and his heirs and assigns forever.
I also give devise and bequeath to the said Charles Smith the lot at Barney's River known as the Quarry lot which I own on the South Side of the highway from the road to the foot of the Bank of the River and adjoining George McKay's West line, from the Barney's River road to the foot of the Bank of said River to Have also to him the said Charles Smith to him his heirs and assigns forever.
I ordain and appoint my daughter Wm Fisher's wife as Executrix of this my last Will and testament.

There is also a few notes of hand not collected which I leave with Jennet Bell Fisher, William Fisher's wife for her own use.

I do hereby certify that the foregoing instrument consisting of one & a half pages, is an exact and literal copy of the last Will and Testament of William Smith late of Ponds, Merigomish, in the County of Pictou, Esquire, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
Given under my hand at Pictou this 1st.day of April A.D. 1898.
