Estate of Thomas B. Smith late of New Glasgow, Carpenter, deceased, Testate

Copy of Will for the Registrar of Deeds

I, Thomas B. Smith of the Town of New Glasgow, in the County of Pictou and Province of Nova Scotia, Carpenter and Builder being of sound and disposing mind and memory do make and publish this my last Will and Testament.

I give devise and bequeath my estate and property real and personal as follows, that is to say,

I give devise and bequeath to my daughters Hazel Brown Smith the sum of Five Hundred Dollars being part of the proceeds of the Sale of a property on James Street, in said town of New Glasgow and also a further sum of Five Hundred Dollars to be taken from the proceeds of my life insurance Policy which said two sums of money my executors shall deposit in the agency of the Bank of Nova Scotia in said Town of New Glasgow in the name of my said daughter and the interest arising from such deposits shall be paid annually to my wife Christina Smith in the care and maintenance of my said daughter Hazel Brown Smith until she shall arrive at the age of twelve years, when a sum not to exceed one hundred dollars annually shall thereafter be paid to my said wife Christina Smith for the education, care and maintenance of my said Daughter until she arrives at the age of Eighteen years.

It is further my Will that my executors shall as soon after my decease as my by them be found convenient sell and convey by Deed, to do with full power and authority is hereby given, that certain Dwelling house owned by me with the appurtenances, in which the Rev. Mr. Rogers now resides - together with the lot of land on which the same is situate, bounded and described as follows, Beginning on the western boundary of Temperance Street at the point of intersection with the north eastern boundary of Forbes Street, Thence to run North westerly along the boundary of said Forbes Street Sixty feet, Thence North easterly parallel to said Temperance Street One hundred and five feet or to the line of the Methodist house lot, Thence South easterly along said Methodist house lot, Sixty feet or to said Temperance Street, Thence South westerly along said temperance Street one hundred and five feet or to place of beginning.

And the proceeds from Sale divide into five equal parts, which I give devise and bequeath as follows, One part to my wife Christina Smith and Her heirs and assigns. One part to my daughter Hazel Brown Smith aforesaid and her heirs and assigns. One part to my daughter Bessie now of Haverhill in the State of Massachusetts, wife of Frank Holmes and her heirs and assigns. One part to my daughter Claude Louise now of the State of Indiana wife of F. E. R. D. H. Gross, and her heirs and assigns. One part to my daughter Christina now of Nanaimo, British Columbia, wife of T.S. Robertson and her heirs and assigns.

I give devise and bequeath to my beloved wife Christian Smith in lieu of Dower, the sum of Fifteen hundred Dollars to be taken from the proceeds of my life insurance Policy to her and her heirs and assigns forever. I further give and bequeath to my said beloved wife Christina Smith, for and during the term f her natural life providing she remains unmarried after my decease the house and appurtenances in which I now live together with the lot of land on which it is situated being the residue remaining after the aforesaid described lot of land and premises have been sold as hereinbefore directed together with buildings and appurtenances thereunto belonging as a home for my said wife and daughter Hazel Brown Smith at the death of my said wife, it is my will that the said house and lot of land hereby reserved for her use shall be sold and the proceeds thereof, I give devise and bequeath to my said daughter Hazel Brown Smith and her heirs and assigns forever. In the event of my said wife marrying after my decease it is my will that she will thereby immediately forfeit all right to the interest, dower, claims, property and Demand of in to or upon the said dwelling house, lands and premises reserved for her use as aforesaid and the said dwelling house lands and appurtenances shall be sold and the proceeds from such sale I give devise and bequeath to my daughter Hazel brown Smith and her heirs and assigns forever.

I give devise and bequeath all the residue of my estate real and personal of every kind and nature whatsoever to my said beloved wife Christina Smith and her heirs and assigns forever.

I hereby appoint my friend James Eastwood of said town of New Glasgow Jeweller, lawful Guardian of my said daughter Hazel Brown Smith. I further appoint of my said friend James Eastwood and my said beloved wife Christina Smith Executors of this my last Will and testament.

In witness whereof I have Signed, Sealed, published and declared this Instrument as my Will at said New Glasgow this Twenty third day of March in the year of our Lord One thousand eight hundred and ninety seven.

The said Thomas B. Smith at said New Glasgow this Twenty third day of March A.D. 1897 Signed and Sealed this instrument and published and declared the same as and for his last Will and Testament, and we at his request and in his presence and in the presence of each other have written our names as the subscribing witnesses.

I do hereby certify that the foregoing instrument consisting of three pages, is an exact and literal copy of the last Will and Testament of Thomas B. Smith late of New Glasgow, in the County of Pictou, Carpenter, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
