Estate of James W. Smith late of Merigomish, Merchant, deceased, Testate
Copy of Will for the Registrar of Deeds
This is the last Will and Testament of James W. Smith of Merigomish in the County of Pictou, Merchant.
I, James W. Smith being of sound and disposing mind do make and publish this my last Will as follows,
1st. I give devise and bequeath to my wife Christina Smith the homestead at Merigomish consisting of a lot of land Bounded on the South by the Railway, on the west, North, and East by lands of John S. Copeland containing one fourth of an acre more or less, with the improvements and buildings thereon, my said wife to Have and to Hold the same and to her heirs and assigns forever. But it is hereby reserved that she my said wife shall not sell convey or assign said lot of land to any person or persons except one of her own sons or daughters.
2nd. I give devise and bequeath to my son James T. Smith a lot of land situate at Merigomish aforesaid and bounded as follows, on the north by the highway, on the east and South by lands of John S. Copeland on the west by lands owned or occupied by Charles Robertson containing sixteen square rods more or less. To Have and To Hold the said of land to my said son James T. Smith his heirs and assigns forever.
3rd. I give devise and bequeath to my daughters Christina Jane alias Mrs. Cahoun, Charlotte C. alias Mrs. Fisher, and my sons David C. Edwin, and James T. five dollars each, to be paid by my executors hereinafter named out of my estate.
4th. I give devise and bequeath to my wife Christina Smith all my personal property of whatever nature or description also all moneys, accounts, promissory notes which shall remain after paying the expenses of my funereal, and proving this my last Will and testament, paying all my just and lawful debts and other bequests herein made. But whatever money, accounts, or promissory notes that shall remain unused or uncollected at the death of my said wife I give devise and bequeath to my son Frederic W. Smith.
I hereby nominate and appoint my said wife Christina Smith and Frederic W., Executrix and Executor of this my last Will and Testament.
In witness whereof I the said James W. smith have to this my last Will and Testament subscribed my name and affixed my Seal this twenty first day of March A.D. 1895.

Signed Sealed and published and declared by the said James W. Smith as and for his last Will and Testament, in the presence of us, who at his request and in his presence, and in the presence of each other subscribed our names as witnesses thereto.

I do hereby certify that the foregoing instrument consisting of one & a half pages, is an exact and literal copy of the last Will and Testament of James W. Smith late of Merigomish, in the County of Pictou, Merchant, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
Given under my hand at Pictou this 10th.day of May A.D. 1897.
