Estate of Samuel Simpson late of Merigomish, Farmer, deceased, Testate

Copy of Will for the Registrar of Deeds

This is the last Will and Testament of Samuel Simpson late of Merigomish, in the County of Pictou Farmer, I the said Samuel Simpson being of sound and disposing mind do hereby make and publish this my last Will as follows, -

First - I give devise and bequeath to my wife Christy Simpson during the term of her natural life that lot of land situate at said Merigomish, Bounded on the east by lands now belonging to the heirs of the late Patrick McKeown, on the north by the Harbor of Merigomish on the west by lands of the said David Simpson, and on the South by the waters of the French River containing twenty three acres and one half acre, be the same more or less, my said wife to have and to hold the same during her natural life and at her death I will and bequeath the same to my four daughters Catherine Isabella Jane and Margaret and their heirs share and share alike and the survivor of them on condition hereinafter mentioned.

Second. I give devise and bequeath the eastern half of the dwelling house in which I now reside to my said wife Christy and my said four daughters Catherine Isabella Jane and Margaret and their heirs share and share alike and the survivor of them on condition hereinafter mentioned.

Third. I give devise and bequeath to my said wife Christy and my said four daughters Catherine Isabella Jane and Margaret and their executors administrators and assigns share and share alike and the survivors of them all my personal property of whatever nature and description which shall remain after paying expenses of my funeral ad proving this my will and paying the other bequests hereinafter made also on the following condition,

The condition of the above bequests is so far as they relate to my said daughters, that in the event of the marriage of any or all of my said daughters the share or share of such married daughter or daughters shall immediately upon her or their marriage cease and determine and her or their share as the case may be shall therefrom go to my said wife and the surviving unmarried daughters and their heirs and in the event of the death of my said wife or the marriage as aforesaid or death of any or all of my said daughters the said property hereby devised and bequeathed shall go to the survivor or survivors of them and their heirs and the said real estate or any part thereof shall not be sold or conveyed by said daughters without the consent of my executors & executrix hereinafter named while they or either of them remain executor and executrix of this my last will.

Fourth. I give devise and bequeath to my sons David and Duncan (my son Daniel having been already provided for) and their heirs the sum of ten dollars each to be paid to them by my executors out of my personal estate.

I hereby nominate and appoint my said wife Christy Simpson and John D. Fraser of Merigomish Councillor the executrix and executor of this my last Will and testament.

In testimony whereof I have the said Samuel Simpson have to this my last Will and Testament (contained on two sheets of paper) Subscribed my name, and affixed my seal this First day of May A.D. 1885.

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of Samuel Simpson late of Merigomish, in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
