Partition of Real Estate, & plan for Register of Deeds

In the Court of Probate, 1882

In the matter of the Estate of Nathaniel Powell Senior, late of Little harbour, in the County of Pictou, ship Carpenter, deceased, Intestate.

The commissioners appointed to divided the above estate have apportioned as follows that is to say, they apportion to Margaret McDonald all that part of the Real Estate descending to the said Margaret McDonald by inheritance of blood from Jane Forbes, wife of Nathaniel Powell Senior aforesaid being lot No. 5, in the Plan hereunto annexed, and also the parts of the Real Estate of which the said Nathaniel Powell Senior died seized, being detached and separate portions marked No. 1 and No. 2 - in the annexed plan as being contiguous to and adjoining her other Lot No. 5, as on said plan as her share and portion out of her said Father's Real Estate, and they the said Commissioners further represented that in their opinion the remaining part of the said Real Estate being No. 4 on the plan aforesaid containing Forty eight acres more or less, could not be divided among the other seven heirs at Law of the said deceased without prejudice to the estate, and they further reported and represented that according to their jjudgement and belief the respective interests of the said heirs at Law being George Powell, William Powell, Thomas Powell, deceased, his heirs or representatives, Annabell Powell, another husband Pius McMillan, Catherine Powell, John Powell and Jane Powell, and her husband George Chisholm, amounts each to the sum of Thirty two dollars money of the Dominion of Canada, subject to an equitable proportion of expenses in their behalf in the matter of partition of the said Real Estate incurred,

I do hereby certify that the foregoing is a true copy of the lots respectively set off and alloted by the commissioners appointed for that purpose a plan of which is hereto annexed, the same having been confirmed by a Decree of the Judge of Probate of this County, dated the 15th. day of December A.D. 1882, as by reference thereto will more fully appear, now on file in the Registry of this Court.
