Certified Copy of Will for Reg of Deeds Pictou

I James T. Paulin of Pictou in the County of Pictou, Coal Dealer, do make publish and declare this my Last Will and Testament hereby revoking all wills by me at any time heretofore made.

I hereby nominate constitute and appoint Charles W. Ives and Daniel Sutherland both of Pictou in the County of Pictou Shipbuilders to be the executors and Trustees of this my Will.

I give and bequeath to Janie McDonald daughter o my deceased wife such portion of my household furniture beds and bedding as she may select for her own reasonable requirements.

I give and bequeath to said Charles W. Ives my best watch and chain to be by him selected if there is more than one.

All the residue and remainder of my real and personal property and estate of whatsoever nature and kind and wheresoever situate to my executors and Trustees hereinbefore named upon trust that my trustees shall sell call in and convert into money the same or such part thereof as shall not consist of money and the moneys produced by such sale conversion or calling shall with and out of  ready money pay my funeral and Testamentary expenses and debts and shall out of the residue of such monies invest the sum of three thousand dollars in the name of my said

executors and trustees and for the benefit of the said Janie McDonald to whom shall be paid the income thereof half yearly so long as she shall live and remain unmarried. And I will and declare that my trustees may at the request of the said Janie McDonald in her life time express such portion of the principal sum of three thousand dollars as my trustees my consider necessary or proper  for the comfortable care and maintenance of the said Janie McDonald. After the death or marriage of the said Janie McDonald I give and bequeath the said sum of three thousand dollars or such portion thereof as may remain unexpended to the Trustees of the Methodist Church Pictou in trust for the uses of such church.

I do further direct that my executors and Trustees shall out of my monies and estate that shall remain after the investment of said sum of thee thousand dollars pay the following legacies viz.

To Annie McKenzie daughter of John David McKenzie Old Road the sum of five hundred dollars.

To Edith McFarlane wife of Daniel McFarlane Pictou the sum of thee hundred dollars.

To Amy McFarlane daughter of said Edith and Daniel McFarlane the sum of five hundred dollars and the sum of four hundred dollars to be invested by my executors and Trustees and the income arising therefrom applied to the maintenance and education of said Amy McFarlane until she shall attain the age of twenty one years when she shall receive the principal sum of five hundred dollars.

To Janie McFarlane daughter of said Edith and Daniel McFarlane the sum of three hundred dollars such sum of three hundred dollars

to be invested by  my executors and Trustees and the income arising therefrom applied to the maintenance and education of said Janie McFarlane until she shall attain the age of twenty one years when she shall receive the principal of three hundred dollars.

To the Trustees of Laurel Hill Cemetery Pictou the sum of two hundred and fifty dollars to be paid in ten equal annual installments of twenty five dollars each.

To Clarence Henderson the sum of one hundred dollars in recognition of his long and faithful service

To James Paulin Henderson son of the said Clarence Henderson the sum of two hundred dollars such sum of two hundred dollars to be invested by my executors and Trustees and he income arsing therefrom applied to the maintenance and education of the sad James Paulin Henderson until he shall attain the age of twenty one years when he shall receive the principal sum of two hundred dollars.

To Annie Ives daughter of my friend Charles W. Ives hereinbefore named the sum of two hundred dollars.

After payment of the foregoing legacies in full without abatement of any kind I will and direct that all the residue and remainder of my monies and estate shall be paid to my brother John Paulin twenty of such parts.

To the Treasurer of the Pictou Cottage Hospital four of such parts.

To Mrs James McIntosh Pictou one of such parts.

In witness whereof I have subscribed my name to this my will on this and the preceding sheets written this twenty seventh  day of November in the year of our Lord one thousand nine hundred and two.

This is a codicil to the last will and Testament of me James T Paulin of Pictou in the County of Pictou Coal Dealer which bears date the twenty seventh day of November 1902 A.D.
Whereas by my said will I have instructed and directed my executors and Trustees therein named to sell and convert into money my property and estate. Now I hereby declare and it is my will that my said executors and Trustees may postpone the sale and conversion of my real and personal estate or any part thereof for as long as they shall think fit ad I do further authorize and empower my executors and Trustees named in said  will to carry on the business of dealing in coal and wood now carried on by me at Pictou and all that appertains thereto for the period of two years after my decease or for such shorter period as my said executors and Trustees my think mbest and to employ such assistants and Servants in the said business and to pay such wages and salaries as they may reasonably consider proper.

I do further authorize and empower my said executors and Trustees in their discretion to compromise compound or settle any question or dispute that may arise in and about the winding up of my estate or the said business in suc manner as they may think fir and generally do and execute all such acts and things in relation to the premises as may appear to them necessary or expedient without being answerable for any loss that may arise thereby.
And I direct that the interest rents and profits and income of my real and persona estate which shall for the time being remain unsold and unconverted including the profits arising from my said business from and after my decease shall be paid and applied to the person or persons and in the manner to whom and in which the income of the monies produced by such sale and conversion would for the time being be payable or applicable under my said will if such sale or conversion had actually been made.

I further will and declare that my said executors and Trustees may in their discretion postpone the payment of my legacies by said will bequeathed and for which no time of payment is fixed for a period not exceeding two year from the date of my death always excepting the income or annuity payable to Janie McDonald either whole or any part of which my executors and Trustees are authorized to pay half yearly in advance out of any monies belonging to my estate.

In all other respects I ratify and confirm said will.
