Copy of Will for the Registrar of Deeds

I George Patterson of New Glasgow, in the County of Pictou and Province of Nova Scotia, Minister of the Gospel, being in good health, but sensible of the uncertainty of life, and desirous that after my decease my worldly affairs be settled without trouble to my heirs do make this my last Will and testament, as follows.

First, I will that all my just debts, funeral and testamentary expenses be paid.

Secondly, All my household furniture and personal property, except as herein provided, I give and bequeath to my dear wife Margaret, if she shall survive me, for her own use during her lifetime, with power to dispose of the same, if she shall see fit.

If she shall have made no dispositions of them during her lifetime, it is my will that at her death the same shall do to my daughters Helen and Louisa for their own use absolutely.

If my said wife shall predecease me, then it is my will that the same shall be theirs at my death, they having provided a large part of the same.

Thirdly, Of my library (1) I give and bequeath to my son George Geddie all my historical works, including any in church history that he may choose, also all in law, science, and philosophy, also the Encyclopedia Britannica, Smith’s Dictionary of the Bible, Alford’s Greek testament, English Hexapla, Lange’s Commentary if he desires it, and also my literary curios or antique publications that I may be possessed of at the time of my decease.

It is my will that these be counted to him at the sum of four hundred dollars in the Settlement of my estate, (2) After my said son George has received the books thus specially willed to him – I will that my wife, if she survives me, have any of the residue that she may choose, and that after that, she or in the event of her not surviving me, my executors shall at her or their discretion, distribute among my other children any books that they may desire. After they have made their selections, I will that my son George have any of the residue that he may choose.

(3) All that remain after this, I give and bequeath to my nephew I. George P. Miller, if he shall at the time, of the settling of my estate he engaged in the work of the Holy Ministry, to be used or disposed of for his own benefit in any way that he may see fit. But if from my cause he should at that time not be so engaged then I bequeath the same to the Board of Management of Manitoba College, to be disposed of as they may deem best for that institution. If however, I should leave any memoranda with this my last Will and testament regarding the distribution of any of these books. I wish them to be attended to.

Fourthly, To my son Hugh I give and devise the sum of five hundred dollars, intending this as an equivalent to him for what I have done for my other sons during their lifetime, the same to be paid to him as soon as the two policies of Life Assurance which I now hold, one from the Scottish Amicable Life Assurance Association, the other from the Clerical Mutual shall have been realized.

Fifthly, As soon as the said policies of Life Assurance are realized, I will that my executors hereinafter named, set apart the sum of two thousand dollars as a trust fund to be kept by them safely invested, the interest to be paid by them yearly to my daughter Mary, free from all control of her husband, during her lifetime.

Further it is my will that f her daughter Margaret should survive her, and should be under the age of twenty five at the time of her decease, my said executors shall apply the interest to her benefit, in the way they deem most for her interest, till she reaches the age of twenty five years, and that on her reaching that age, or in the event of her having reached that age before her said mother’s death, the principal shall be paid to her the said Margaret Irving.

If the said Margaret Irving shall die without issue before her mother my said daughter Mary, then it is my will that on the death of my said daughter Mary the said principal be distributed as the residue of my estate is by this will ordered to be. If however the said Margaret Irving die in the circumstances mentioned but leaving offspring, then it is my will that the executors apply this trust fund principal and interest for the benefit of such offspring, exactly in the same manner as is here ordered regarding this mother, the said Margaret Irving.

Sixthly, It is my will that if my said wife survives me she shall have the use of the house and property on which I now reside in New Glasgow, during the term of her natural life, and at her death if she shall survive me, or if not on my death, I give devise and bequeath the same to my daughters Helen and Louisa to their own use absolutely.

Seventhly, The residue of my estate, I will that if my wife shall survive me, my executors shall keep safely invested, and pay the interest to her yearly, during her lifetime and on her death or on my death, if I shall survive her, I will that the same be divided equally among my children, Helen, Louisa, Hugh, and George, share and share alike.

Lastly, I appoint as executors of this my last Will and testament, my son George Geddie Patterson and John H. Sinclair, Esquire, Barrister at Law of New Glasgow.

I do hereby certify that the foregoing instrument consisting of three pages, is an exact and literal copy of the last Will and Testament of George Patterson late of New Glasgow in the County of Pictou, Minister of the Gospel, deceased,Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
