Estate of James Murphy, late of Cape John, Farmer, deceased, Testate
Copy of Will for the Registrar of Deeds
This is the last Will and testament of me James Murphy of Cape John, in the County of Pictou, farmer.
1St. I give devise and bequeath unto my son Joseph Leonard Murphy, who left home about twenty five years ago, all the real estate of whatsoever kind or nature and wheresoever found, belonging tom me at the time of my decease, upon this express condition however, viz. that he shall return within one year to my residence at Cape John and there to live with me and care for me during the unexpired term of my natural life, but if he will not return as aforesaid, or if he is not now living, then this bequest shall be null and void. and I do give devise and bequeath the same namely all the Real Estate of whatsoever kind or nature and wheresoever found belonging to me at the time of my decease unto my daughter Margaret Murphy.
2nd. I order and direct that all my personal estate & effects whatsoever belonging to me at my decease be sold by my executors and the proceeds thereof be equally divided among my surviving sons and daughters.
3rd. I do hereby nominate constitute and appoint Thomas Robison, and my son Alexander Murphy of Cape John joint executor of this my last Will and Testament, hereby revoking all former testamentary writings.
In witness whereof I have hereunto my hand and Seal Subscribed and Set this seventh day of January in the year of our Lord, one thousand eight hundred and eighty eight.

I do hereby certify that the foregoing instrument consisting of one page, is an exact and literal copy of the last Will and Testament of James Murphy, late of Cape John in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
Given under my hand at Pictou this 15th day of September A.D. 1894.
