I William Maxwell, Minister of the Gospel, residing at Durham, Pictou County, Nova Scotia do make this my Last Will and Testament, on this the sixth day of August in the year of our Lord one thousand eight hundred and ninety six.

I hereby appoint my son William Maxwell, farmer, residing at Durham, Pictou County, Nova Scotia, and my daughter Mary wife of Peter grant, farmer, residing at Lower Stewiacke, Colchester County, Nova Scotia, is to be my sole executors and to have all power competent to executors.

And I hereby instruct my executors to bury my body at the Pine Tree and out of my estate to place a plain headstone on my grave.

And further after paying all death-bed and funeral expenses my said executors will pay the sum of fifty dollars to each of the following five persons or to such of them as shall be alive at the time of my death: - namely my wife Eliza Anderson, my daughter Mary Maxwell or Grant, my daughter-in-law Harriet Roy or Maxwell, my sister-in-law Mrs. James Maxwell and my niece wife of John William Roy, Woodburn.

And further I instruct my executors to pay into the estate of my late brother James Maxwell the sum of five hundred dollars, to put the sum in the bank and to pay the interest yearly to his widow Mrs. James Maxwell, ad ant her death to divide the said five hundred dollars among the legatees of my late brother according to the provisions of his will.

And further my said executors will pay to my wife Eliza Anderson for her own and sole use and disposal the sum of nine hundred dollars.

I bequeath to my son William John Maxwell, my gold watch, wearing apparel, my study table; and also that portion of my farm on which I now reside being on the east side of the mill-dam and known as the meadow.

All the rest of my said farm lying inside the mill-dam with the buildings and stock and crop I leave to my wife for her use during the remainder of her life, with the provision that it shall not be rented. And at my wife’s death, or before that event, should she cease to live on the farm it shall become the property of my said son William John.

I further leave to my wife all the furniture and household effects that may be in the house at the time of my death for her own use and to be at her own disposal, with the exception of my study table bequeathed to my son William John, and six old mahogany chairs which I leave to my daughter Mary. I also leave to my said daughter Mary that lot of woodland on the Shubenacadie river below Fort Ellis formerly owned by the late James Maxwell.

Whatever belonging to me, if anything, may remain after paying the above sums and meeting the above bequests and defraying all expenses connected with the settlement of my affairs shall be divided into tow equal parts and the one part I leave to my son William John, and the other part to my daughter Mary.

My books I leave to my children to divide between themselves.

Be it understood that in the event of ether one or both of my children dying before me, whatever I have thus left to the one or the other shall, in that case, be divided share and share alike between their surviving children respectively.

In witness whereof these presents written by me on this and the preceding page are subscribed by me at Durham aforesaid, on this the sixth day of August in the year of our Lord one thousand eight hundred and ninety six in presence of William McDonald and James W. Smith both residing at Durham foresaid.

McLeod Registrar of said Court do hereby certify that the foregoing paper writing is a true copy of the last Will and Testament of William Maxwell late of Durham in the County of Pictou Minister of the Gospel deceased which said will was duly admitted to Probate in said Court at Pictou on the 17th. day of August AD 1907.
