Description Will of David Matheson of Pictou, NS

(Handwritten) Estate of David Matheson late of Pictou, Esquire, deceased, Testate Copy of Will for the Registrar of Deeds In the name of God, Amen. I David Matheson of Pictou, Esquire, Do make and declare this my last Will and Testament. I give devise and bequeath to my son Robert McKay Matheson his heirs and assigns, the Melford Farm (so called) at West River with the privileges and appurtenances thereunto belonging, so far as necessary towards procuring and furnishing a Home for the whole family, in which, including Edward shall be interested in the following proportions, Mother and Mary and Emily one share each, Robert two shares, and Edward half of one share, the balance if any to be divided among them in the same proportions and no one to sell their interest out of the family without the consent of at least the majority (Words scratched out here and initialed) of the rest, or when the said farm is disposed of the proceeds may be divided among the said family in the shares or proportions above stipulated instead of investing in a Home as abovementioned on condition they all agree thereto, in writing. I give to my beloved wife and two daughters Mary and Emily one thousand dollars each and to the two latter one share each of Stock Nos. 18668 & 18669 respectively in the Books of the Bank of British North America. I give to Edward my son One hundred dollars and direct that the account against him in the Memo. Book for money advanced ** be wholly scored off. I give to my son Robert the furniture and Books in or belonging to me in the office and all the money on hand and Securities for money legally or equitably due me at the time of my death. I direct that should James Carter pay the amount due on his mortgage and Bond without having to resort to legal measures the enforce the same, that Robert abate (insertion) $50 on the amount due at the time of payment, but that the matter be settled and closed with all reasonable dispatch, I also give to Robert my son the horse and Cow, the waggon, Sleigh, and harness Saddles, bridles i.e. and everything belonging thereto. I give all the household furniture of every kind and description and all the remainder of my personal property to my beloved wife our daughters and Robert share and share alike to be divided among them as they may agree.- Having full confidence that will one and all do what is right in the premises. I will and direct that Robert do pay all funeral expenses and debts due by me at the time of my death. I do nominate and appoint said son Robert and Executors of this my Will, trusting they will see the same, to the utmost of their ability, faithfully and honestly carried into effect according to the purport true intent, and meaning thereof.
