Certified Copy of Will for Reg of Deeds Pictou

This is the Last Will and Testament of me William P. McNeil of New Glasgow in the County of Pictou, and Province of Nova Scotia, Manufacturer.

I direct that all my just debts and funeral and Testamentary expenses to be paid and satisfied by my executors hereinafter named as soon as conveniently may be after my decease.

I devise and bequeath all my real and personal property and estate of every nature and kind of which I may be entitled or in which I may have any interest to my wife Annabel McNeil during her lifetime, the income profits rents and interest accruing from the same to be hers absolutely during her said life subject to the demands and stipulations hereinafter contained.

My executors and Trustees hereinafter named shall have the power to call in at reasonable and proper times any moneys now invested, and to reinvest the same in any investment which they shall deem reasonable secure and likely to return a fair annual income and with power to retain investments made by me in my life as long as they shall think proper and to reinvest the proceeds of the same part thereof in similar securities the income in all cases to belong to and be the property of my said wife during her life time.

The said executors and Trustees shall also have the right to sell any property hereby devised or bequeathed and to give good and proper transfers conveyances and titles to the same the moneys accruing from any such sale or sales to be invested as hereinbefore specified for the benefit of my said wife during her life time.

I hereby direct that out of the income herein provided for my said wife that she pay to my sister Jane McNeil ($100.) one hundred Dollars per annum to be paid to her at such times and in such manner as may be most convenient for the use of said Jane McNeil, and I also direct and request that the said Jane McNeil be allowed the use of the house and premises she now occupies in New Glasgow free of rent, taxes or any other charges during her life time, the said house and premises to be kept in good and habitable repair for the use of said Jane McNeil,

And if at any time the said house now occupied by the said Jane McNeil shall be destroyed by fire or otherwise then my said wife is to provide her with a suitable ad proper residence in lieu of he the one she now occupies or make any other satisfactory provision for the said Jane McNeil it being my intention that the said Jane McNeil should be properly cared for and supported in health ad sickness out of the said income during her life time.

At my wife’s death I direct that all my real and personal property owned by or to the credit of my estate shall be converted as afar as need be into Cash by sales or otherwise and that of out of the proceeds Four thousand Dollars in Cash be paid to Archibald F. McNeil my youngest son and then the balance and residue shall be divided equally among my four sons Charles M. McNeil, Walter S. McNeil, William A. McNeil, and Archibald F. McNeil.

If any of the said sons shall die leaving a child or children the said division shall take his or their father’s share.

It is not my intention to prevent by this will a division of the property hereby devised and bequeathed at any time before my wife’s death provided a mutual arrangement between the parties interested can be made of such division and in any division made of said estate at any time it shall not b necessary to convert the same into Cash provided a mutual arrangement can be made whereby the investments and property can be divided satisfactorily to all concerned.

I further direct and request that my wife Annabel McNeil continue to keep up the home during her life time at New Glasgow similar to the way in which it is now kept by me out of the income herein provided for her so that it may be a home for herself and any member of my family who wish to remain at home and reside with their mother.

I hereby nominate and appoint my wife Annabel McNeil, Charles McNeil and Walter S. McNeil to be the executors and Trustees of this my Will.

McNeil late of New Glasgow in the County of Pictou Manufacturer deceased which said will was duly admitted to Probate in said Court at Pictou on the 25th. day of A D April 1905.
