Estate of Robert McNeil late of Little Harbour, Esquire, deceased, Testate

Copy of Will for the Registrar of Deeds

I, Robert McNeil of Little Harbour in the County of Pictou make this my last Will and testament this Twelfth day of May A.D. 1890.

First - I give and bequeath to my wife Janet A. McNeil all that property House and buildings in New Glasgow bought by me from Clarence Patterson and fully described in the Deed from him bearing date Oct. 22, 1889, together with all the personal estate in said house and buildings, also all the personal property and household furniture on the Farm and old homestead at Little Harbour to be for her Sole use and benefit forever.

Second - I hereby authorize and empower my Executors hereinafter named to sell the property on Forbes Street New Glasgow, the real Estate in Cumberland County, and any other real Estate belonging to me excepting the old Homestead at Little Harbour) should they deem it advisable to do so.

Third - I give and bequeath to my son Frank the farm at Little Harbour (the old Homestead) at a valuation of Two Thousand Dollars $2000 to be accounted to him at that price, at the final distribution of my property.

Fourth - I give unto my son John  All my books for his own use and to distribute to any member of the family he sees fit to give them to, but not to be given away or sold out of the family.

Fifth - I order that all my property not hereinbefore bequeathed and devised including al monies at interest, Bank Stock, notes of hand, mortgages, and investments of whatever kind shall be invested by my executors and executrix  according to their discretion, and to them may appear wise, and the proceeds of the same be used by them and at their discretion for the maintenance of my family and educating the same, until my youngest child living shall become Twenty one years of age, and at that time my property shall be distributed as follows viz. -  one Third to my wife Janet A. McNeil and the balance to be equally divided between my children then living or their legal Heirs and I further declare that as my Four oldest sons respectively attain the age of Twenty five years, my Executors are authorized at their discretion to pay such Son or Sons their or his proportion of the property herein devised.

Sixth - I also further declare that my executors or each of them shall not be responsible or liable for any loss, if any, that may occur in any investment made by them except such as may be due to culpable negligence or fraud.

Seventh - I further declare that my said Executors, and each of them shall respectively be chargeable only with Such monies as they shall respectively actually receive and shall not be *aussoerable for each other.

Eighth - I order that John have a free home at the House of his mother at all times he feels disposed to live there.

Ninth - It is to be understood that all monies now invested in trust for my wife or any member of my family shall be accounted for as belonging to  my estate.

Tenth - I hereby appoint my wife Janet A. McNeil, Executrix and my two sons M.D. McNeil and Frank H. McNeil, together with my trusty friend James D. McGregor Executors of this my last Will and testament. The erasure on the Eleventh line from the top being made before Signature.

I do hereby certify that the foregoing instrument consisting of two & a half pages, is an exact and literal copy of the last Will and Testament of Robert McNeil, late of Little Harbour in the County of Pictou, Esquire, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou this 15th. day of December A.D. 1890.
